Hey guys...
Can you look over this contract and tell me what you think?
This is the contract I revised for my a perspective boss (as apposed to the totaly horse $*** contract he gave me...)
Is it too demanding? Did I forget anything?

Duration of Employment:
The institute and employee have agreed that the duration of the employment will be for the term of 12(twelve) months, beginning on and ending on
Responsitiblities of the Employee:
1. Employee shall perform the duty as teacher, teaching 120 hours per month, according to the monthly class schedule programmed by the institute.
2. Employee shall teach extra hours (1-2 additional hours per day at the regular hourly rate) when necessary in order to fill a term schedule of 120 hours per month (refer to compensation).
3. Employee shall accept and comply with all the rules and conditions stipulated at the Teacher's Manual adhering to behavior becoming a teacher and professional in class.
4. Employee shall not obtain employment from any other party including but not limited to institutions and/or organizations unaffiliated with the institution while the terms of this contract endure. Failure to comply with this rule is cause for immediate dismissal.
5. Employee shall participate in the orientation program as planned by the institute typically scheduled one-week prior to the beginning of an employee's first monthe of teaching. Employee will be paid half of her regular hourly wage for the days spent in orientation.
6. Employee shall accept and comply with the instructions, supervision and training of the CEO Head Teacher or one of the management staff.
7. Employee will stricktly adhere to and abide by all laws, regulations and instructions provided by the national and local governemtns of the Republic of Korea.
8. Employee will be expected to substitute for a teacher who is unable to attend class due to illness, insofar as the actual teaching hours do not exceed 8(eight) hours per day. Employee will abide by the substituting schedule created by the CEO Head Teacher or one of the management staffs. Employee will be paid the overtime hourly wage for each class she substitutes.
9. Additional duties include administrative work related to employees clasroom activities. The additional duties will not exceed 2 hours work per day. The employee is not required to have office hours or remain at the school longer than 8 (eight) hours per work day.
10. The employee will be required to attend faculty meetings, participate in regularly scheduled field trips, and attend seminars and workships sponsored or recommended by the instutute including the ESS anual Membership Training. These events will be paid at the normal hourly rate when they exceed the 120 contract hours.
11. Should employee have a class cancled in a given month, the employee will be responsible for making up an equivalent number of hours of work by performing a special project to be determined by the CEO Head Teacher or one of the management staffs. Special projects can be a tutoring program.
Compensation:
1. Payment is in Korean currency of 2.1 million won to be paid on the fifth of each month for services rendered by the employee during the previous month.
2. The Instutute agrees to the payment of 2.1 million won even if the class hours fall below 120 hours per month.
3. The regular hourly wage is established at 25,000 won per hour.
4. Employee shall pay employees share of the montly bills. In the event that the employee does not pay the employees share of the montly bills, the institute will deduct this amount, including penalty charges, from the employees monthly salary. Prior to departing Korea the employee will sign the Last Months Utilitie and Phone Bill Settlement Form and leave the appropriate amount of money with the Institute in order to pay the incoming bills that the employee is still responsible for.
5. Employee shall sign the rental agreement before the employee moves in to the apartment.
6. If the employee declines the option to reside in an apartment provided by the Institution, the employee will be given a housing allowance of 300,000 won per month.
Health Insurance:
The Employee will join the Korean National Medical Insurance program. The Institute will pay one-half of the fees, and charge the other half to the employee.
Airfare:
1. The Institute agrees to pay the employee 500,000 won to partially compensate the employee for her flight to Korea.
2. If the Employee resigns before having worked six full months at the Institute, the employee will reimburse the Institute a proportional amount, dividing the amount origionally paid by how many months the employee has worked, assuming the Institute has been reimbursed in 6 months time.
3. If the employee wants to renew wants to renew the contract, the price of the one-way airfare will be given to the employee in liu of a ticket.
4. The Institute agrees to pay for the employee's visa run to Japan. This includes transportation, hotel, visa, and meals.
Paid Sick Leave:
1. Employee may take up to 3 (three) days of paid sick leave in the contract year.
2. Employee will be reimbursed for unused sick days at the sucessful completion of the contract at the rate of regular hourly wage.
3. If Employee uses all the agreed sick days and requires additional days off due to illness, the Institute will withhold the normal hourly amount to compensate the substituting teacher.
Vacation:
1. Employee will be allowed a paid vacation for 1(one) week after each 6 (six) month period of work at the Institute.
2. Employee cannot take her vacation days during the months of January, February, July or AAugust, as they are the busiest months for the Institute.
3. The Employee will consult with one of the management staff at least 50 days in advance of taking her vacation.
Holidays:
Employee will observe, and be paif for the same national holidays that are observed by the Institute.
Class Days:
1. Employee will teach Monday through Friday. Each month the class session begins on the first weekday of the month and ends on the last weekday of the month.
2. Employee will teach every weekday in months with 20(twenty) weekdays. In months with 21(twenty-one) weekdays, the Employee will be given one day off. In months with 22 (twenty-two) weekdays, the Employee will attend a one-day workshop in addition to the day off.
3. Employee will work on saturdays during months in which saturday classes are necessary in order to fulfill a 20 (twenty) day session for that month.
Voluntary Resignation:
Employee will submit written notice to the Institute 2 (two) months in advance of Employees planned departure from the Institute. Employee understands that 2 (two) months is required for the Institute to find a replacement.
Legal Action:
Incase of litigation, all legal proceedings and concerns shall be taken in accordance with and under the jurisdiction of Korean law.
Dismissal by the Institute:
1. Employee understand and agrees that the Institute reserves the right to dismiss the Employee if the Employee does not abide by and comply with the provisions stipulated in this contract.
2. In case of miscounduct, the Head Teacher will afford the Employee one verbal warning at the time of the first offense. If the problem persists, a formal written warning will be given at the time of the second offense by the management staff. A third offense will be cause for dismissal.
3. A criminal or dishonorable deed by the Employee that may cause damage to the reputation of the Institute is cause for immediate dismissal of Employee.
4. If Employee has below 35% of re-registration rate for 3 months in a low, it can be a reason for the dismissal of the employee.
Renewal of Contract:
The Institute and Employee may sign and renew the contract for another year based upon mutual agreement.
Agreement:
All terms and matters regarding the employment of Employee listed and provided for in this contract are mutually agreed upon by the institute and employee on this day , 2006, and no other terms, except written amendments signed by both parties are valid. |

Why are you still talking hours? How many classes? Between when and when? 2-9...whatever! You could end up working splits from hell with this wording

Not a chance! If they want you to teach an additional 1-2 hours a day make sure its at overtime rates!

Make sure you have a copy of this!
4. Employee shall not obtain employment from any other party including but not limited to institutions and/or organizations unaffiliated with the institution while the terms of this contract endure. Failure to comply with this rule is cause for immediate dismissal.

Not acceptable....call it what you will but orientation is work. Just for instance the hourly wage should be mentioned here. You also want to make sure that you have your VISA before you start work!

Multiple bosses means multiple headaches!

its overtime....if you want it then fine...if not........then problem

With this tacked on I would say walk away! They want you to do 2 hours of prep a day teach an extra 1-2 classes a day(at regular pay) and substitute when needed....I freakin gaurantee you will be at the school much longer than 8 hours a freakin day!

As long as they are held Mon-Fri during regular business times!

Making up classes you miss...ok....classes they cancel? No freakin way!

If this is the regular hourly wage then whats overtime? 32,500?

Late fees? Or penalty charges? Most Korean companies(utility) dont have late fees! I would definately want this removed!

They should cover your entire airfare to Korea....most places do.

I dont like this clause either.....lets do some math shall we? Salary 2.1 mil divided by 20 working days is basically 105,000 won a day....now if you are there 8 hours a day thats 13,150 an hour....but they say the hourly wage is 25,000 won an hour....quite the difference. Now if you were being paid 25,000 won an hour in reality your salary would be 4 mil a month!
Vacation:

Translates into: You will work long hours for little money for the good of the school

30 days in advances should be plenty....Hell 2 weeks is plenty!

How about: observed by all Koreans!

Not really sure what they are talking about....almost every month has at least one holiday in it....unless they dont count holidays as missed days in which case this wouldnt be so bad.

AHA! No freaking way! This is a sneaky underhanded way of getting you to make up national holidays! If they want you to come in to makeup classes on Saturdays then demand overtime......or refuse

Allowing 30 days written notice or a months pay in lue of!

Any criminal conviction(delete dishonorable deed....who decides what is dishonorable?.....you were seen holding hands with a Korean girl in town...YOU'RE FIRED!)

NO WAY! That is one burden that cannot be put on the shoulders of a teacher!

Exact dates are required here. You should get contractual language written in the contract stating your employment commences on your E2 Visa Issue date and ends on your E2 Visa Expiry date. It's also important to have contractual language stating you will work for the employer when you have been issued an E2 Visa from Korean Immigration Officials. Employers in Korea are notorious for pressuring teachers into working while on a Tourist Visa which is illegal.
Responsitiblities of the Employee:
1. Employee shall perform the duty as teacher, teaching 120 hours per month, according to the monthly class schedule programmed by the institute.
I would stick with a basic 6 hour shift, unless you like working split shifts. Change 120 hours to "120 classes per month throughout the contract period", according to the monthly class schedule programmed by the institute.
What are the operational hours of the school?
How long is each class?
What's your daily schedule?
What does a class hour/class consist of?

If you are not supplied with enough working hours/classes per month by your employer, then you shouldn't be required to teach make-up classes. That's your employer's fault.

Rules and conditions should be stated in this contract.
4. Employee shall not obtain employment from any other party including but not limited to institutions and/or organizations unaffiliated with the institution while the terms of this contract endure. Failure to comply with this rule is cause for immediate dismissal.
You may obtain employment elsewhere if you receive permission from Korean Immigration Officials, and get consent from your employer (which would have to happen anyway).

This is illegal if you don't have an E2 Visa. If your caught working for pay without an E2 Visa, then it's deportation time

You should have overtime amount earned per class written in here. More overtime for you. Make sure you keep records of all the overtime classes you work, and have them sign off on it.

You could possibly be staying at the school 10 extra hours per week, 160 hours per month, and 40 hours could go unpaid. Tell these people to stick this contract up their ass!

You will be paid overtime when you excide 120 hours/classes!

This is exactly why you get contractual language worded in your favor (working times/classes taught per month) so you don't end up with this crap clause!

Ask to see a copy of the rental agreement before signing it. They can forward it to you via. e-mail if they had the time to send you this crap contract.

Sample health insurance clause
The employer will enroll the employee in the Korean National Healthcare Insurance Plan. The employee will be physically presented with his medical insurance card on __________/__________/__________. The sum of 3 months contribution, **********, will be prepaid by 3 month intervals (the contribution payment duty is retroactive to the day he/she was registered for his/her residence in Korea) except for the permanent foreign resident. Responsibility to pay said sum of 3 months contribution is upon the employer. The employer will deduct **********(2.24%) from the employee's monthly salary and pay it to the National Health Insurance Corporation per month throughout the contract period.

You will find better contracts out there, and keep looking. Be patient. Grotto has corrected his fair share of contracts on www.eslcafe.com, and I would seriously take his advice into consideration.

This is actually a fairly reasonable contract. You should talk to some other teachers there.
It does look like a school with split shifts. Be aware of this in advance. Some people like splits. I could never do them. This depends on your personal preferences. I know a teacher who does splits, has done them for years, and really enjoys the free time during the day, working only early mornings and late evenings.
Since it looks like you are already in Korea, they are giving you an airfare payment and paying for a visa run. That's nice. They could pay more, but most wouldn't give this.
You have 20 teaching days per month. That means that in many months you have an extra day off on top of your vacation and holidays. Having to work a Saturday to keep the school schedule on track is no big deal. Get a calendar for 2006 and 2007 and look at the weekdays and red days. In June, July, August and September of this year you would have an extra day off. In October you would probably have to work on one Saturday or holiday to keep the school on track. This is fair to the customers (the students) and the workers (the teachers). You could get 8 or 10 days per year as extra days off under this contract! Check a calendar.
You should get paid FULL PAY for a week of training. Ask for it.
You cover sick days for other teachers and they cover for you. What else would you expect? You get paid for doing it. If your sick days are excessive, you pay for the other teacher who is being required to cover for you. Reasonable.
The regular hourly wage appears to be the overtime rate. Get it fixed. 25,000 won overtime rate.
Many Korean companies DO have late fees and penalties for paying late. You should expect to pay them if you pay late.
Two months is a reasonable requirement to require as notice for resignation. It is the MINIMUM required these days to find a qualified, professional teacher. (An unskilled monkey can be replaced in 30 days, however.)
If less than 35% of your students fail to reregister you will be FIRED at any hogwan, whether or not it is in your contract. It means that either you are personally a bad teacher or that the whole school is failing or both. Game over. This is just a statement of reality.
You do want to get taxes and pension cleared up in your contract. They should be handled according to the Korean law. See the NTS website.
You MUST talk to other people who are working currently and have previously worked at this or ANY OTHER place you are considering.
Since it looks like you are in Korea now, have you visited or will you visit the school? You should.
Ask for 2.2 million minimum. More if you're a good teacher. |

Well if the original contract was bull then it might be an indication of the quality of the job. If the original proposal was crap...it is a serious red flag that you can't ignore. Even if you revise it and they accept, there is a possibility that when you get there the contract clauses won't be honoured.
I would keep looking for a contract that only needs minor revisions before accepting one that you had to completely re-arrange. |

This is a good contract. You wrote it. There is nothing wrong with rewriting a bad contract. If the employer agrees to your contract, it's a good sign that they trust you. Many employers use standard contracts provided by hogwan associations or recruiters. They are usually badly written. Some clueless foreign teachers and kypos write "standard" contracts that are just as bad.
You do need to put in something about taxes and pension. Maybe you want no taxes or pension so that's why you left them out. If you're not from a country that can get a refund then why pay.
You should get 2.2 million. Did you already agree to 2.1 million?
See my other comments above.
Some people on Dave's nitpick contracts. That's easy to do if you're not really looking for a job here anyway. |

No, its still not a good contract....no set hours, teach whatever classes then +1-2 hours overtime + coming in 2 hours early...thats good? riigghhhhttt!

This clause causes me some concerns as it doesnt address the impact of national holidays or vacation time.
January 22 days, Feb 20, Mar 22, April 20, May 23, June 22, July 21, Aug 23, Sept 21, Oct 22, Nov 22, Dec 21.
Now with 13-15 national holidays to take into effect......I would definately want some clarification on this....if they dont impact the time then its good....if they do....you're screwed! |

The clause about 20 work days per month is quite clear. Just look at a calendar. It means that, in addition to regular national holidays, you will get additional time off in many months. You will get 8 or so extra days per year in addition to national holidays. This is the system at many hogwans. THe one limitation is in months with excessive holidays where the teacher will have to work to keep the number of class days at 20. It's actually a guarantee for the students and the teachers that the days worked and paid for will always be 20 per month. Pretty fair.
The airfare being half paid is in addition to a visa run. Not bad since the teacher is already in Korea. Many schools, including public schools, won't pay for airfare if you're already here and have no airfare.
And as I said, you should ask for full pay for training.
Also, as alabamaman pointed out, you need to put in more about the single housing they should be providing you. See his post on this. |

I would still want clarification on this! It looks like to me, that you will work all weekdays regardless of holidays and you have to work Saturdays in order to make sure that 20 classes are taught per month. They need to clarify it as one way its a good deal and the other its a rape waiting to happen!
So you have to teach 20 classes each and every month....considering that there are 10 holidays that fall on weekdays you will end up making these classes up on Saturdays in exchange for a day off a month.
You're exchanging 10 days for 10 days...you dont end up coming out ahead from my viewpoint |

If you look at a 2006 calendar (I don't have a 2007 calendar here):
Month / Non teaching days (over 20)
Jan: 1
Feb: 0
Mar: 2 (so one will be a meeting day)
Apr: 0
May: 2 (meeting)
Jun: 1
Jul: 0
Aug: 2 (another meeting)
Sep: 1
Oct: -1 the only month you'd have to make up a day
Nov: 2 (another meeting)
Dec: 0
So, if you had this job for 2006, you would have 11 non teaching weekdays in addition to holidays, 4 of which could have meetings. You would have to put in one make up day. You would have a net gain of 6 extra days off on top of your national holidays and vacation.

I dont think one of us is interpreting it correctly.
The OP said that there are 20 "teaching" days per month and that missed days would have to be made up on Saturdays to ensure the "20" days per month.
SO if you teach 20 days per month each and every month then you are obviously losing Sats and National holidays and exchanging them for 10 days.
It looks more like we will give you this with one hand and take away that with the other.

Grotto, you need to look at a calendar. There are 31 days in 7 months. (4 months have 30 days and Feb has 28days, but the same principle applies.) If you teach 20 of them, that leaves 11 days free. Now look at the weekends and holidays (the red days) and the weekdays. You will see that there are usually more than 20 work days in a typical month, even after the holidays and weekdays have been removed. These days are given as extra days off. The students get exactly 20 days. That is what the OP said. I know of several schools using this system. The teachers get lots of days off at the ends of months and they never schedule the meetings mentioned in the contract (although they could).
There is only one month in 2006 (October) where the teacher would have to work a makeup day on a Saturday or give up a holiday. This part of the contract is a nice little perk. See my list. It is quite clear. |
