I have an associate who has quit, & whose hagwon director refuses to accompany them to Immigration to fill out paperwork for a letter of release. A former teacher at the same hagwon had the same problem with this same Director, after being fired. Are there any effective tactics to compel a Director to attend & complete a letter of release? Who are Hagwon Directors reponsible to? The Labor Board, Regional Education Board, Immigration Head Office in Seoul?
There must be some organisation these Directors fear? |

What are the reasons the associate quit? That may help the forum members out a little more in determining a proper course of action. You could pay the cost for the one way ticket to Korea. Some hagwon owners get pretty upset after forking out the dough to fly you over here. If she has serious violated the conditions of employment per Article 26 of the Labor Standards Act numerous times you may have a case to terminate your labor contract. What's going on at your hagwon though? The Labor Board will need more than she made me stay late than 5 minutes after class, and yelled at me once. |

I do know firsthand that it is possible to simply turn your ARC in at the airport then return to Korea from Japan or wherever and apply for the E-2 visa again w/o any problems.
This happens all the time. Immigration knows it and understands that the dirty Hogwan owners are responsible for causing this horrible inconvenience and headaches.
Tell your present hogwan to shove it-. Blacklist THEM! |

Your associate could always go to Immigration by himself (or with someone who speaks Korean) and tell them that proper notice was given (proper notice was given right?) and the employer refuses to give a release letter.
Immigration may cancel the visa and give him an exit order at that point in which case he'd be free to search for and take another job without need of a release letter.
Whoever he talks to at Immigration, be sure to take a name and note the time and date, location, department, office, etc. Immigration officers tend to make up the rules as they go along so being able to point to a person will help you out, they won't want to step on the toes of a superior or even another co-worker. |

| Get a list of the parents' phone numbers and contact them with a bilingual Korean friend. Tell them you wish to meet to discuss 'concerns' about their children's education. Trust me, it will freak the shit out of them, and the boss will gladly make a trip to immigration. |

If a hagwon terminates employment, must it write a Letter of Release?
If so, would it be more advisable to get fired than to quit? |
