I know it's a little late, since I am leaving on Saturday, but maybe there are some things that you can point out for me... possible negotiation strategies?
I already found out that some things are a little misleading - the contract says that it will pay for a round trip ticket, but they will only pay $1,600.00 I discovered, after booking my $2,000.00 flight and e-mailing my principal.
Also... How many of you signed the contract *after* you got to Korea? The principal said that this was a sample contract... should I be a little worried, or is this the norm?
Anyone ever heard of this school? It's in the Kangnam area of Seoul. Thanks folks!!!

워릭영어학원(주)(이하 '갑'이라 칭함)와 (이하 '을'이라 칭함)은 다음과 같이 고용계약을 체결한다.
'WORWICK Language Studio for Kids (WORWICK hereunder) and (Employee hereunder) makes the employment agreement under the condition of hereunder.
1. 근로계약기간 (Duration of Employment)
2006년 월 일부터 ~ 2008년 월 일까지.
From_______________________2006 to 2008.
2. '을'의 의무, 역할 및 근로내용 (Obligation and role of Employee)
�을�은 �갑�과 계약 시 4년 제 대학 졸업장 또는 영사관에서 공증 받은 졸업장의 복사본을 제출해야
하며 봉인된 성적증명서를 제출해야 한다.
To be a legal English teacher at WORWICK, the employee should present original university diploma to WORWICK or a notarized copy of the original diploma appropriated by the Korean Consulate and sealed transcript for immigration office.
B. '갑'의 담임영어선생으로서 '갑'에 등록한 수강생들의 영어교육과 '갑'의 영어 교재 구성에 참여.
As home class English teacher of WORWICK, the employee should participate in teaching English and producing English education materials.
C. 유치부 수업은 월요일부터 금요일까지 아침 9시30분부터 오후 4시30분까지이며 수업준비를 위해 수업시간 30분전에 출근해야 한다. 수강생들과의 신뢰감과 친밀감 형성을 위해 점심시간에 아이들과 식사를 하던지 아니면 식사지도를 30분 동안 한다.
WORWICK's kindergarten classes start from 9:30am and finish at 4:30pm from Monday-Friday. but teachers should come to school at least 30min before beginning of class for the daily readiness of class. When the employee eats lunch with kids, WORWICK provides lunch. The employee should stay with kids in the classroom for the first 30minutes of lunchtime for teaching lunch table manners.
D. 매 학기별 오픈클래스와 학부모-교사의 만남행사에 참여하여야 하며 이는 시간외 근무에 포함되지 않는다.
When PTM(Parents and Teachers Meeting) and �Open Class�are scheduled once or twice in every semester, employee should participate in those events. Both PTM and Open Class are not overtime work.
3. 근로조건 ( Terms of employment)
기본급 : 2.0m/month (Basic) (09:30 � 16:30)
Basic wage : 2.0m/month(Basic) (09:30 � 16:30)
B. 시간외 근무 수당 : 시간당 23,800원
Extra hourly wage : 23,800 Krw
C. 숙박제공 : 워릭은 근로기간동안 숙소를 제공하며 월세를 제공한다. 단, 숙소가 필요 없는 경우 월 40만원의 월세상당금액를 지원한다. 워릭은 숙소에 기본적인 가구들, 즉 텔레비전, 냉장고, 세탁기, 가스렌지 그리고 침대, 에어컨을 설치한다.
WORWICK provides housing and pays rent for employee. If the employee does not need housing, housing allowance of 400,000 Korean Won for employment period (400,000 Korean Won / month) will be paid. Basic furnishing will include TV, refrigerator, washing machine, gas range and bed, the accommodation will also be air-conditioned.
D. Lunch : 아이들과 점심을 같이 먹는 것을 경우 제공한다. 단, 사정에 따라 변경이 가능하다.
WORWICK provides lunch for employee if employee takes lunch in class with students. If the employer and the employee both want to make alterations on this term, it may occur.
E. 지급방식 : A항과 B항을 기준으로 급여를 매달 마지막 근무일에 지급한다.
WORWICK should pay a full monthly wage based on the terms from A to B on the last working day of the month.
F. 연가 (Annual paid holidays) : 연간 10일 (10 paid holidays per year)
학기 중 학생방학기간 10일을 사용할 경우 4일의 추가휴가를 제공한다.(If the employee uses student�s vacation period, the employee gets extra 4 paid holidays)
최초 3개월간 근무 후 휴가를 사용할 수 있다. (The employee should stay at least first 3months to use paid holidays)
G. 병가 (Sick leave) : 연간 2일 (2 sick paid days per year)
H. 항공권 제공 (Airplane ticket) : 계약종료시점에 본국 귀국용 왕복항공권을 제공한다. (When the duration of this agreement expires, WORWICK provides roundtrip airplane ticket for employee to home. 단, 한국에서 다른 근무처에서 계약이 종료된 후 워릭과 계약 체결된 경우 본국귀국용 편도항공권만을 지급한다. (If the contract is made after working in other school in Korea or during traveling in Korea, WORWICK only provides one way airplane ticket to home country when the contract expires.
I. 계약연장보너스 (Severance pay) : 전 달의 급여수준을 기준으로 1개월치의 보너스를 계약종료일에 지급한다. Upon completion of contract, there is a one month severance pay(bonus) due on the last day of the contract, along with the last month salary.
J. 건강보험 및 국민연금 (Health insurance & National pension) : �을�은 건강보험과 국민연금에 가입하여야 하며 �갑�, �을�이 50%씩 부담한다. 건강보험료는 급여의 1.5%, 소득세는 급여의 0.5%, 국민연금은 급여의 4.9%정도 공제되며 캐나다와 미국은 한국과의 협정에 의하여 납부한 국민연금을 전액 보상 받게 된다.
The employer and the employee should apply for health insurance and national pension and pay 50% each. Medical/Health insurance will be approximately 1.5%. In addition, currently, the approximate income tax rate is 0.5%. The approximate income tax rate is 0.5%. The approximate national pension contribution according to regulation on behalf of the employee is 4.9%(which may be adjusted according to the changes of Korean Tax Law). Upon completion of the contract, pension contributions will be fully reimbursed to the employee from USA & Canada by the Korean government according to Korean Law.
K. 비자 취득 비용 지원 (E-2 Visa) : �을�이 비자가 없을 경우 �갑�은 �을�의 E-2비자취득과 관련한 일본 왕복 항공권과 비용 등 일본에서 비자를 취득하고 돌아오는 데 필요한 비용일체를 지원한다. If the employee does not obtain work visa in the country of his/her residence, the employee will receive full visa sponsorship from the employer upon arrival to Korea. This will include a paid round trip air ticket to Japan (to obtain work visa there) and money to cover travel expenses.
4. '을'의 근로규정 (The Korean Labor Standard Act)
'갑'은 한국의 근로기준법에 근거하여 차별 없이 '을'에게 적용하도록 하며 '을'도 근로기준법에 근거하여 근로함을 원칙으로 한다.
WORWICK should apply 'the Korean labor standard act' to employee and employee also should work according to 'the Korean labor standard act'.
5. 저작권 (Copyright)
'갑'이 �을�과 제작한 '영어교보재'의 저작권에 관한 일체의 권리와 책임은 모두 '갑'에 있으며 '을'은 어떠한 경우에도 저작권에 대한 이의를 제기할 수 없다.
The copyright of the English materials that WORWICK produces with employee is in WORWICK Language Studio for Kids.
6. 을의 신상문제 (Status of Employee)
'을'은 한국에서 행한 위법 및 불법행위에 대한 책임을 지며, 이로 인해 발생하는 모든 비용을 책임진다. 또한 '을'이 이 계약내용을 불이행함으로써 '갑'에게 손해를 끼쳤을 경우에는 '을'은 그 손해에 대한 책임을 져야 한다.
Employee takes full responsibility for his behavior in Korea and should pay for all kind of fee or fine which he should pay in Korea. And he also takes full responsibility from breaking this agreement.
7. 관할법원 (The court of Law)
이 고용계약은 대한민국 국법에 의하며, 이 계약서에 명시되지 않은 사항은 외국인 고용에 관한 법률과 일반적인 상관례와 대한민국 고용기준법에 준하여 원만히 처리한다. 만일, 문제가 발생하였을 경우 소송관할 법원은 '갑'의 관할법원으로 한다.
This employment agreement is made by Korean law, but if any missing articles are in this agreement, WORWICK and Employee make mutual agreement according to the usual practice related to the employment of foreigners and respective Korean Labor Standard Acts.
이 계약은 '갑'과 '을'의 서명으로 즉시 효력을 발생하며 계약체결을 증명하기 위하여 계약서 2부를 작성, 서명한 후 각각 1부씩 보관한다.
This agreement is valid as soon as WORWICK and Employee signs. |

A few things. Eating lunch with kindy kids? While not a deal-breaker... if you like peace and quiet while eating your meal you can forget it. Not only that, but the cafeteria food will be typically Korean. Kimchi, rice, soup and a couple of assorted side dishes (EVERY DAY)
3F looks funny. You can't get paid for national holidays until you have stayed three months? Get clarification. You should get paid for ALL national holidays and don't let them tell you different.
Tax rate is too low, and pension is too high, (pension is 4.5% of salary). Make sure that the tax rate is not a typo and that they don't mean 5% (which would be too high). |

Signing it after you get to Korea means taht you will have to wait about a week for your visa to process. (the signed contract is one of the papers that immigratio needs). They may ask you to work during this period. DO NOT. i would make that clear before you leave that you will not work until you have a work visa in your passport.
Also, who is paying for your visa trip to Japan? Its not mentioned anywhere in the contract, which I assume means you are paying for it.
The rest of the contract looks decent, except what was already mentioned about pension. |
