Hi there,
I am leaving my job at the end of August. I will have worked here for two years. I did not receive severance pay after completing my first contract.
I have heard that severance is the average of your last 3 months' pay. But is this pay only your standard pay, or does it include 'extras' such as camp payments, and 'extra classes for gifted children' (over and above the 22 hours per week).
My boss is pressuring me to sign something right now, so I need to find out soon.

It is TOTAL pay. What did you get paid in your last 3 months regardless of the circumstances? Add it together, divide by 3 and that's severance pay.
So if you were paid 2 million for the 1st month, 2.2 million for the second and 2.4 for the 3rd, your severance would be 2.2 regardless of what your salary is/was |

Is there any proof of this (to show my boss in writing, or refer him to the source)? I've been looking around but can't seem to find anything.

Article 19 (Definition of Average Wages)
(1) The term ???average wages??? used in this Act means the amount calculated by dividing the total amount of wages paid to a relevant worker during three calendar months immediately before the day on which a cause for calculating his average wages occurred by the total number of calendar days during those three months. This shall apply mutatis mutandis to the employment of less than three months.
(2) When the amount calculated pursuant to provisions of paragraph (1) is lower than that of the ordinary wages of the worker concerned, the amount of the ordinary wages shall be deemed his average wages.
Article 34 (Retirement Allowance System)
The retirement allowance system under which an employer pays retiring workers a retirement allowance shall be in accordance with the Guarantee of Workers' Retirement Benefits Act.

Thanks for your replies.
I ended up calling the Labour Board, and the man I spoke to confirmed that it is an average of my total pay for the last three months of my contract.
My Supervisor wouldn't take my word for it so I rang the Labour Board again and passed the phone to my supervisor. (They are still talking at this moment). Hopefully it will get sorted out. |
