Man, these things are flying in left and right, my head is spinning from thinking about what to choose. The contract I'm going to post below is for a school in Shingil dong , Seoul. They want us there in 8 days, but I'm not sure my girlfriend and I can do that..... Anyway, right after receiving this contract we received another offer in a public school in Ulsan for 2.5 million, 4 weeks vacation, 9-5 with 5 teaching hours, two bedroom apt. and all the other usuals. I'm telling you, this is overwhelming. Anyway, on with the contract, again, any help would be appreciated!

1. TERM OF CONTRACT (계약 기간)

This contract will be valid for a period of 12months beginning _____ _ and ending _ .
(※ Starting date�s up to your arrival )

본 계약서는 _ __ _____ 부터 __ _____ 까지 12개월 기간 동안 유효하다.
(※ 시작일은 강사의 도착 일에 따라 달라짐. )


2. CONDITIONS OF EMPOLYMENT (고용 조건)

a). The Employee will act in an appropriately professional manner and be responsible for conducting professional English Language classes.
피고용인은 적합한 직업의식을 갖추어 전문적인 영어 수업진행에 임할 책임이 있다.

b). The Employee will be required to work for regularly scheduled hours from Monday to Friday, Each teaching hour in excess of 30 hours a week, totally 120 hours a month is considered as overtime.
피고용인은 월요일부터 금요일, 주 30시간 월 5일 근무를 원칙으로 하며, 월 120시간 이상은 오버타임으로 적용된다.

c). Classes and teaching hours are scheduled at the institute's sole discretion.
수업시간은 학교의 상황에 맞춰 계획된다.

d). The Employee is required to go through an orientation and raining program before starting Employment.
피고용인은 고용된 후 첫 근무일 전에 오리엔테이션과 교육을 받아야 할 의무가 있다.


3. SERVICES PROVIDED BY THE EMPLOYER
(고용주의 의무 이행 사항)

a). PAYMENT & TAX 급여 지급
The Employer will pay a monthly salary of __2,100,000_won for regularly scheduled hours which we mentioned on the page 1 worked.
(Payment of salary commences from the first day of teaching.)
고용주는 피고용인에게 매 달 page 1에서 언급된 정상적인 근무시간에 대한 용역 제공에 대하여 매 달 __2,100,000__원의 급여를 지급한다. (급여는 가르치기 시작한 첫날부터 계산된다)

b). The Employer may ask the Employee to work over time (the Employee has an option to refuse and will not be forced), and if the Employee chooses to do overtime, the Employer will pay for the overtime at the rate of _25,000_ won.
고용주는 피고용인에게 정상적인 시간외 근무를 요구할 수도 있으며 (피고용인은 고용주의 요구를 거절할 수도 있으며 강요 당하지 않을 것임) 피고용인이 시간외 근무에 동의하였을 경우 고용주는 시간당 _25,000__원을 지급한다.)

c). The employee salary will be paid on the 30th of each month.
피고용인은 매달 _30 _일에 급여를 지급 받는다.
The first payment is on 30th of the next month. (최초의 봉급은 다음달 30일에 지급한다)

d). Tax for income will be deducted from the salary according to the Korean tax law, and The Employer will provide the Employee the receipt for this.
피고용인의 월급에서 한국 세법에 따라 세금을 공제하며, 고용인은 이에 대한 영수증을 제공한다.



4. HOUSING (주택 제공)

The Employer will provide the Employee a furnished Single housing and the Housing will be provided at no cost to the Employee with the exception of maintenance and phone bills.
A two-person apartment/house will be provided for a couple, if both are teaching at the Institute.
고용주는 피고용인에게 기본적인 가구가 준비되어 있는 숙소를 고용주의 부담으로 제공한다. 단 관리비, 상수도, 가스, 전기, 전화 비용은 사용자인 피고용인이 부담한다. 커플일 경우에는 두 사람 이 사용할 수 있는 숙소를 제공한다.

5. AIRFARE (항공편)

Employer shall provide round-trip ticket. In the event that INSTRUCTOR willfully leaves the Employer before completion of his/her contract, Employer is not responsible for the return airfare. If INSTRUCTOR willfully leaves the Employer before 6 months, INSTRUCTOR must payback the initial airfare and EMPLOYER may deduct the said airfare from Instructor's last pay.
학원은 왕복 항공권을 제공한다. 강사가 자의로 계약 만료 전 학원을 떠날 경우 학원은 돌아가는 항공권을 책임질 필요가 없다. 만일 강사가 6개월 전에 학원을 임의로 떠날 경우 강사는 첫 항공료를 학원에 반납해야 하며, 학원은 강사의 마지막 월급에서 항공료를 공제할 수 있다.

6. MEDICAL INSURANCE (건강 보험)

The half of the insurance premium will be paid by the Employee and the other half by the Employer.
고용주는 피고용인의 보험 가입 시 보험 비용의 반을 부담하며, 그 외의 비용은 피고용인이 부담한다.


7. SEVERANCE PAY (퇴직금)

Upon completion of this contract, the Employer will pay one month's salary as a severance payment to the Employee. This payment will be made at the time of completion of the contract period.
피고용인이 12개월의 계약기간을 이행했을 경우, 고용주는 한달 분의 급여를 퇴직금으로 피고용인의 계약 기간 마지막 날에 지급한다.

Deposit( 예치금)
After six months starting working, for three months, the Employer will collect 100,000won per month deposit for utilities and phone charges even if the teacher pays these charges each month. This deposit will be refunded on the last day(the completion of this contract).
근무 시작 월부터 3개월동안은 고용인은 매달 10만원의 예치금을 각종 공과금 예치금을 예치하고 마지막달에 반환받는다.

8. VACATION (유급휴가)

a). The Employee may have 10-working days as paid vacation per year, which will be organized by the institute. (days in which the Employee does not regularly work i.e., Saturdays, Sundays and National Holidays are not to be considered as part of the vacation period)
피고용인은 학원에서 주어지는 날짜에 맞춰 년 10일간의 유급 휴가를 갖는다. ( 국경일과, 토요일, 일요일은 이에 포함되지 않는다)

b). Employee's paid sick leave during the Term of Employment shall not exceed three (3) calendar days. (a doctor's invoice with the diagnosis and prognosis is required to be paid for sick days.)
피고용인은 3일간의 병가를 받을 수 있다.
(병가를 받기 위해서는 의사의 처방전이 요구 된다)
In the case where the �employee� does not use any of his/her three sick days, the �employee� will receive a Bonus of \70,000 upon completion of the contract period (병가를 사용하지 않을 경우에는 70000원을 보상한다)


9. RENEWAL & TERMINATION OF CONTRACT
(재계약과 계약 파기)

a). RENEWAL (재계약)

The Employee must give the Employer a written 60-day notice before renewal or non-renewal of the Employee's current contract.
피고용인은 고용주에게 재계약 가부 여부를 피고용인의 현 계약기간 만료 60일 전에 알려줘야 한다.

b). Both the Employer and the Employee reserve the option to renew the contract.
고용주와 피고용인은 재계약 선택에 대한 권리가 있다.

c). TERMINATION OF CONTRACT (계약 파기)
Both parties will give at least a written 60-day notice prior to the termination date of the contract.
쌍방은 계약파기 의사를 문서화하여 계약 파기일 60일 전에 서로에게 통보하여야 한다.

d). The Employer retains the right to terminate the contract
immediately if:
고용주는 다음과 같은 사항에 의하여 계약을 파기할 수 있는 권리가 있다.

* The Employee is unable to discharge the responsibilities or meet the conditions such as being late for class on a continuous basis, continuous failure to keep regularly scheduled class hours and repeated absences from classes without a valid reason.
피고용인이 본인의 책임과 의무를 실행하지 못할 경우, 예를 들면 연속적으로 수업에 늦거나 연속적으로 정해진 수업시간을 지키지 못했을 경우, 그리고 합당한 이유없이 연속적으로 결근 할 경우

*.The Employee teaches a private class outside of the school.
피고용인의 근무처가 아닌 다른 곳에서 근무를 했을 경우

*. The Employee participates in any type of criminal activity of corruption of public morals which violates the laws of the Republic of South Korea.
피고용인이 대한민국 법에 어긋나는 불법 행위를 하였거나 범죄행위에 연루 되었을 경우

If, for any reason, the contract is terminated before the full completion of the contract period:
만약 어떤 이유로든 본 계약서가 계약기간 전에 파기가 됐을 경우에는:
The Employee will not qualify for benefits such as severance pay and the airfares.
피고용인은 퇴직금과 항공편에 대한 혜택을 받지 못한다.

The Employee will be wholly responsible for any /maintenance and phone bills remaining for the duration of their housing lease.
피고용인은 고용주가 제공한 숙소에서 거주하는 동안의 관리비, 상수도, 가스, 전기, 전화 비용에 대한 책임이 있다.

Within 14-days the Employee is required to sign a notice of termination and accompany the employer to the Korean Immigration office to notify the Korean Immigration office of the termination.
피고용인은 계약을 파기한 날짜를 기준으로 하여 14일 안에 고용주와 동반하여 출입국관리소에 계약파기에 대한 통보를 알려야 한다.

10. GOVERNING LAW & JURISDICTION
(법례 및 사법권)

a). This contract is governed by the low of the Republic of Korea.
이 계약서는 대한민국의 법 아래 통제된다.

b). This contract is made final and firm unless any material modification or amendment to this contract is executed with the full knowledge and consent of the undersigned and incorporated into this contract.
이 계약서에 공히 서명하고 계약된 고용인과 고용주의 충분한 의논과 동의에 의한 중요한 변경이나, 수정사항이 실행되지 않는 한 이 계약서는 유효하다.

Which would mean going without an E-2. Don't. There are numerous threads about this, with several in the last couple of days.

There are a lot of public school posters here (lots of free time), so I'll let them comment on this. Many people seem to consider a public school position a step up from a hagwon. I'm guessing that at least one person will implore you to jump on the public school offer. Not having worked a public school, I can't say one way or the other. Just make sure you do your research about what it entails, e.g. lots of free time, large classes, Korean co-teachers.

A lot of people will dis Ulsan, but take it with a grain of salt.

One of the first things you should always look at is how they define a teaching "hour." Is it 60 minutes of actual classroom time? Or is it one class (usually 50 minutes)? That makes a big difference in your actual hours worked. In the first case, you'll be working 7-50 minute classes a day. In the latter, 6-50 minute classes a day. There are enough schools offering the former that you don't need to teach the extra class a day for essentially nothing.

Yeah, they had mentioned a 2 day visa run to Osaka, but I'm not sure if that was going to be an immediate thing or if they'd wait a few days...

that contract looks like one offered to a beginner with no experience. thats the same contract i have basically (and its my 1st year). i get 2.1, more vacation (14 in summer, 9 for chuseok, 10 in winter), and everything else is the same (9-5 hours, etc.).

the public school one looks better, but yeah i have no experience with that.

you want to know how many classes you will be teaching. Get it clarified! Employee will teach up to 30 fifty minute classes a week anything in excess of that is considered overtime.

totally unacceptable...split shifts changing schedules Rolling Eyes You want a set schedule...Mon-Fri 2-8 or 3-9...any changes in scheduling must meet with employees approval!

d). The Employee is required to go through a PAID orientation and raining program before starting Employment.
피고용인은 고용된 후 첫 근무일 전에 오리엔테이션과 교육을 받아야 할 의무가 있다.

totally unacceptable! By law they are supposed to pay you during the month worked....this way you would end up working 2 months before getting paid for month one...NEVER accept this nonsense!

Its about 1.5%.....dont let them steal anything more!

you want a complete list of all the furnishings..bed, fridge, AC etc

just say no to deposits they are illegal!....I would agree to leave an average amount of the last 3 months bills on my last pay as a compromise

a). The Employee may have 10-working days as paid vacation per year, which will be organized by the institute. (days in which the Employee does not regularly work i.e., Saturdays, Sundays and National Holidays are not to be considered as part of the vacation period)

If they are going to arrange them have the dates written into your contract

You shouldnt need a doctors note unless you miss 2 or more consecutive days. Also get the amount changed from 70,000 to 100,000(still cheaper for them)

that would be up to the labour board in case of 11'th hour termination

you shouldnt be responsible for the maintenance...perhaps they mean utilities.

Within 14-days the Employee is required to sign a notice of termination and accompany the employer to the Korean Immigration office to notify the Korean Immigration office of the termination.
피고용인은 계약을 파기한 날짜를 기준으로 하여 14일 안에 고용주와 동반하여 출입국관리소에 계약파기에 대한 통보를 알려야 한다.

I've worked in hogwans but now I'm at a public school and I like it much better. Hogwans are mostly about making money and that translates to a lot of pressure on you to retain students. Which can result in a lot of nit-picking. At a hogwan I had to be there physically fewer hours but I worked more than I do now. I'm at school for eight hours and in that time I do all my prep work. I teach fewer classes but have more students in each class. The kids are more respectful. How can I put this simply? My first year here at a hogwan a kid spit on me because I retained him after class for not doing his homework. At a public school the kids bow to me. But that's just my experience. Some people love hogwans.

Most people dont go back to hogwans after working in public schools....the treatment is usually much better, the work less, the hours longer and you are treated better. AND WAY WAY LESS WORRIES!

I will pump for the public school, having worked in both. Thats good money for a public school, and with a government public school atleast its guaranteed.

I am happy in mine, as are the others in the area I think.
