Okay guys, a contractual question for you.
I've noticed that generally most contracts say that after 6 months the employee is no longer liable for the ticket the school gave them TO Korea, although they lose their return ticket.
I've seen a couple contracts that say not only is employee liable for the plane tickets to/from Korea, but that the teacher will also be charged a 1 million won fee for the hiring of a replacement teacher and lose their practice.
Is this a standard practice? Or just a trick to screw unwary teachers?
I have four contracts I'm considering and two of the schools are willing to negotiate and make changes I see fit... so I'm kind of trying to figure out what's square and what's not. Plus I want to be able to say, "This is not a fair/standard practice" with some surety.
I appreciate the help. |

It is an unscrupulous practice but if you are foolish enough to agree to it in writing (by signing the contract) it may/can/will become binding depending on the specifics and the interpretation of the adjudicator at the labor board when you have to fight about it.
Best to either delete it from the contract or an even better choice,
FIND ANOTHER SCHOOL.
Usually when you see clauses like that in a contract it is because the school has historically had a problem with teachers leaving early (for any number of reasons - usually related to mistreatment) or just plain "TOO MANY RUNNERS" and that is NOT good news for you. |

Thanks ttompatz, that was kind of my general feeling. It's funny... because "unscrupulous" was the exact word I used in my reply...
I feel guilty saying it, but as of right now I'm kind of playing them against each other... I hate to be a nagging nelly... but I'm going a long way from home and I'm not gonna get screwed because I didn't make the contract air tight. (OCD isn't always a bad thing.)
I appreciate the help. Thanks! |
