|
|
Hi. Just wanted to ask because I couldn't remember what applies exactly for this particular situation:
I'm planning to hand in my notice half way through an extended contract. Giving the 2 months required notice is no problem for me. I'm not losing out on any bonuses or anything financial.
I plan to return home and not look for another job in Korea. Under these circumstances, do I still need a Letter of Release or can I go without one?
I would also want to stay for 18 days after my final day of employment for a personal project. Can I stay theoretically for as long as until my visa expires if I haven't submitted a LoR to immi? |

You can leave any time. You do NOT need a LOR to quit or leave the country.
You legally have 14 days after the early termination of your employment (assuming you have more than 14 days remaining on your ARC) before you are in an overstay position even if your boss doesn't report your termination promptly. He can do it on day 13 (when he tries to get a visa for a new foreigner) and you still only have until day 14 to be out of the country.
Your visa and your status of sojourn are tied to him. Legally you have to leave within 14 days of your quitting. How you deal with him and immigration is up to you. |

Thanks Ttompatz.
Do you know then, that if I buy a flight out for the 18th day, that I could go to immi before I finish work and effectively get an extension stamp to stay beyond the 14th day you mention? (My ARC date actually expires next spring).
I tried to call immi, but they didn't seem to understand what I was talking about. |
