Hehe, more news from the Haegwon from hell...same one that has been mentioned in various other posts in the last few weeks.

They have decided to end my contract a week early. No problem on the bonus front, but they are deducting my holiday pay in order to "make up" for the week they have decided I'm not to work.

It looks, to all intents and purposes, like a scam to take out my holiday pay before I leave...Surely a school can't just renege on their contract like this?

anyone had any experience of this? Do I have a legal leg to stand on?

Unless they gave you 30 days notice, you should be paid right to the end of when you were originally set to finish. As far as holiday pay is concerned, they should pay you the money if you didn't take the vacation, but this depends on the wording of the contract.

That said though, I highly doubt that the Labor Board will be able to help you, or willing to help you over 1 week's worth of pay. It surely sucks. Move on, and if you are staying in Korea, I hope you find a better place to work.

Most of the money will be in your pocket.

Take the one week holiday-negotiate for more cash.

Doesn't qualify as hagwon hell.

It sounds like you have worked for one year and you are entitled to one week of paid vacation. If that is what you are saying then it is legitimate for the school to give you the final week of your contract off as your vacation week. This should be paid as your regular monthly salary. You should receive no additional vacation pay, but you should have nothing deducted either.

If, on the other hand, the school has already paid you cash for a week of vacation time that you never took, but they are now giving you this week off instead, then it would be correct for them to deduct one week's wages from your final month.

In either case, you should not be paid any additional vacation pay.

This sounds like an accounting problem where someone is having trouble with the math.

Don't do it. It is not a victimless crime.

A victimless crime means there is no victim. When you harm someone's property there is a victim, the property owner. When you steal there is a victim, the property owner. When you commit insurance fraud there is a victim, the owners of the insurance company and the other property owners.

Victimless crimes are things which are criminalized by the arrogant state where there are actually NO victims. If two gay men have consensual relations, it is voluntary and there is no victim. When the state makes this a crime, it is a victimless crime. That is why libertarians want to repeal victimless crime laws.

Destruction of property is always a crime with a victim. Don't do it.

They give you a week off, they take a week. I dont see the problem though. It sounds like you want to work a week AND get another weeks salary for unsused vacation. You're getting your vacation, it's just at the end of your contract. I think if it came down to trying to explain it to the labor board, given the language barrier, (unless you're fluent) they could talk cirlces around you.
Take your vacation week, maybe use it find another job, and move on.
You haven't lost anything.

That's a point.

If you haven't had 10 days holiday,by law,they could say this is that.

Take the holiday then-you'd have to.

Do steal stationary and coffee sachets though.Pinch the receptionists butt if it's worth it
