A Korean friend of mine is having problems with an ex. Does anyone know what the laws are (or have a good webpage that I can look at) regarding restraining orders?

Restraining order in this country I'm sure they exist but enforcment is MOST likely not possible due to the uselessness of Korean police.

You have to go to the court house to get one. The police don't handle it upfront. They told me to go to the court house. I didnt actually get one, but they told me there is a fee. Worth checking out. |

Thanks for the info about the restraining orders. My friends needs custody of her child and infringing on restraining orders may help.

Not to be a downer, but its going to be an upward battle if the husband is Korean as well. Even in cases of abuse it can be very difficult for the woman to get custody of the child. I know this from the second hand experiences of some friends. The police don't want to get involved and often judges wont allow a divorce without the consent of the husband. This is one area where Korea is a bit behind in the times. That being said, she has nothing to lose, and she might get lucky. |

Yes, you can get one, but given Korea's crowded nature, you can only get a maximum five meter restraining order. |

Well, the husband agreed to the divorce. She escaped (and left the country) for a "trip" for quite a while but she's come back and she really REALLY want to get her daughter.
The father didn't even let the child see her mother...EVER...and would get angry when rumours (or even my friend's NAME...or existence) surfaced. |

1) I don't know if she has considered this avenue.
2) She's scared sh1ttless of her husband and getting her to do anything can be kind of hard.
3) Her family is scared of him too.
Anyways, just thought I'd do my part as a friend. |
