My friends E2 will expire on Dec. 31st. Does he need to leave the country immediately or does he get some sort of grace period. He's in the process (first visit to Immi) of changing to an F-2.
Thanks for your insights. |

there's no such thing as a grace period. Ur friend needs to leave on or b4 that day unless an extention is granted at immigration and the reason has to be approved by them. A new years party probably wont be a good reason |

He has a couple of choices.
He can leave the country before midnight on the 31st.
He can overstay, pay the find and jepordize his F2 and future F5.
He can go to immigration BEFORE his expiry and get an extension.
If he is changing to F2 (I assume he is already married) then immi can take care of the paperwork but he MUST do it BEFORE the close of business on the 31st. |
