Hi, I just recieved this contract. What do u you guys think?

Employment Contract
POSITION: English Instructor
EMPLOYER
1. Name of the school
2. Address
Hereafter to be referred to as the
Employer.
EMPLOYEE
1. Employee�s name
2. Address
Hereafter to be referred to as the
Employee.
The parties agree as follows:
1. TERM OF CONTRACT
This contract will be valid for a period of 12months beginning
__________ _____ and ending ___________________ .
(※ Starting date�s up to your arrival )
2. CONDITIONS OF EMPLOYMENT a). The Employee will act in an appropriately professional manner
and be responsible for conducting professional English Language
classes.
b). The Employee will be required to work for regularly scheduled
hours from Monday to Friday, Each teaching hour in excess of 30
hours a week is considered as overtime. Please note that each
class runs for fifty minutes, but is considered a full hour in terms of
payment.
c). Classes and teaching hours are scheduled at the institute's sole
discretion, and will be scheduled in blocks between the hours of
2pm and 10pm. Please note that these times may change during
one-month summer and winter sessions, and the employee may be

asked to work morning sessions instead of afternoons/evenings.
d). The Employee is required to go through an orientation and
training program before starting employment.
e). Teachers are expected to be at school 1hour and 15minutes
before class starts for preparation and other teaching-related
duties.
f) The employee agrees to dress appropriately for the classroom �
clean, neat, and non-revealing.
g). The employee will is entitled to three (3) paid sick days over
the course of the contract, and five (5) unpaid emergency leave
days.
h). All Korean national holidays will be paid by the employer.
3. SERVICES PROVIDED BY THE EMPLOYER

a). PAYMENT & TAX The Employer will pay a monthly salary of _210,0000_won for
regularly scheduled hours which we mentioned on the page 1
worked.
(Payment of salary commences from the first day of teaching.)
b). The Employer may ask the Employee to work over time (the
Employee has an option to refuse and will not be forced), and if the

Employee chooses to work overtime, the Employer will pay for the
overtime at the rate of ____18000 ____ won.
c). The employee�s salary will be paid on the ___ of each month.
d). Tax for income will be deducted from the salary according to
the Korean tax law, and The Employer will provide the Employee
the receipt for this.
4. HOUSING a) The Employer will provide the Employee a furnished Single
housing and the Housing will be provided at no cost to the
Employee with the exception of maintenance and phone bills.
A two-person apartment/house will be provided for a couple, if
both are teaching at the Institute.
b) The Employee will leave 200,000 won as a deposit to cover bills
that will be received once the Employee has departed the country.
5. AIRFARE
Employer shall provide round-trip ticket. In the event that
INSTRUCTOR willfully leaves the Employer before completion of
his/her contract, Employer is not responsible for the return airfare.

If INSTRUCTOR willfully leaves the Employer before 8 months,
INSTRUCTOR must payback the initial airfare and EMPLOYER may
deduct the said airfare from Instructor's last pay.

A few areas you might want to address:

1. Training should be paid and/or find out how long it will be, then decide if you want to accept it.
2. Prep time is a bit excessive. Maybe one hour per day if you are new to teaching. Less, if you have experience.
3. There is no VACATION time! Should be at least 10 days per year.
4. Overtime rate is way too low.
5. No mention of National Health Plan or pension plan.
6. Penalty (if you accept it), for utilities when you leave. Try to work it so you only have to prove they have been paid before you leave Korea.
7. Airfare. Don't agree to pay back after SIX months. Also, the way it is written, it sounds like you pay them and then they also take it out of your pay.

Housing: Make them list what is provided in the apartment.

Thanks a lot!

Vacation time, health care and the pension plan are specified but for whatever reason the contract didn't paste in its entirety.

I'll definitely ask if the training period is paid and I'll take your advice on having them list all amenities included in the apartment. I see your point about the airfare (the wording is strange); we'll have to work on that.

the receipt for this. WOW a receipt, that's different!!!! How much tax will you pay though? % and won?

If you are from USA/Canada ask them to add in pension.

No mention of Health Plan, this should be split 50% each with your employer at a rate of 2.4%

No mention of severance either!!


Look elsewhere ore start negotiating!
