Hey, my hagwon is employing a girl from a local US base. She has no degree. However, she is white and blonde which makes her qualified by my bosses standards. Anyway, it legal for them to be employing her? She lives on the base as the wife of a guy stationed there. I don't really care that they are doing it but if it is illegal, it'd be nice to know. Ya know, just in case the day comes that I need to leverage the bosses. So far so good with them but, ya never know....

As far as I know, that's illegal in 2 ways. She can't work off-base without a Korean work VISA. And even if she somehow got one, she can't legally work by MOE regs w/o a BA/BS.

So yeah, she'd be illegal.

I was pretty sure it was from my limited knowledge. Since some of you guys are like walking encyclopedias of Korean Labor law I thought I would ask to get my facts straight. Is this a fineable offense? I have no inttentions of using this info, I like girl and bosses are ok. I asked them recently about my overtime pay for winter intensives and they have yet to get back to me. However I did get a letter criticizing my teaching skills. It was non threatening and much of the criticism was valid (besides saying my class was boring, my kids cheer me) So, I got my eyes and ears out for business negiotations korean style.

Immigration will slap the owner with hefty fine if your boss is caught doing it. As for the teacher without degree, they probably won't and can't do anything to her because she's covered under the SOFA agreement.

A common misperception about the US-Korea SOFA. SOFA does not exempt anyone from being charged with a crime while in Korea. What it does do; provides rules on jurisdiction and pre-trial confinements for service members and their family if arrested and charged with a crime in Korea.

Yes, you're right if it's serious crime. But immigration violation isn't that serious and Koreans ain't even going to bother.

I've seen times when drunk solidiers beat up and stab a taxi drivers and run into the base and K-police and law couldn't do anything about it. The soldiers do get some sort of disciplinary action from the military and gets hauled off to the states.

Yeah, I thought the worst thing that would happen to her is being told she has to go back to the states. Sounds like this is perfectly blackmail material though. They can pay me the overtime or get nailed by immigration and go through the hassle of hiring a proper teacher.

The only thing you're going to do it get this girl fired. If you threaten to call immigration, do you think she'll still be there by the time they show up? If you like her, leave it alone. You're being petty. And jealous, it sounds.

I intend too, she's not the issue, its my employers following through with my contract is. I'm in a foreign country and for the most part my boss holds the cards in these little squables. Him hiring someone illegally in front of me is just leverage. Business is Business. Anyways, what am I jealous of?

You've SEEN soldiers stab a taxi driver and get away with it??? You'd think that would have made the news...

Quite honestly it sounds like your another anti-American that is going to take out your frustrations with the American government's policies on an innocent party. You don't know for sure that she is working illegally. She may have been giving special permission by the Korean government, who knows.

I don't think risking the poor girls job is a good plan. Your boss will still hold all the cards and can screw you for any made up reason. There's no sense in ruining the life of someone in the process.

Do you think that a miltary person and who's wife was deported because some random guy had a problem with his boss would not be seriously upset and do a little research on who the guy was?

This is Korea, foreigners get messed with and have no job security.

OP- I'd be bothered by it, too, but see how it goes. If she minds her own business and is pleasant, then I'd leave her alone. If she starts crap or is used as leverage over you in some way, then make a call and get her beehind shipped out.
