According to EFl-Law address below, Korean employers " should" pay for one month or give 30 days notice when they dismiss a teacher. This does not sound mandatory.
Has any teacher fought being fired without 30 days notice or not being paid and won? This happened to me and I want to know if I have a chance to win another month's pay from my hogwan.

Dismissal Notice:
The Employer should give at least 30 days notice of dismissal. Otherwise the Employer must pay the ordinary wages for at least thirty days. |

| You forgot to mention that previous to you getting fired, you handed in your resignation. You only gave 3 weeks notice, and when the school asked you to give 1 month notice, you changed your mind and said you weren't quitting. You were fired for cause. Also, did you mention that you were given a reprimand for poor performance. |

It is mandatory; it's one or the other.

Right, they "should" give notice (the preferred option of the two), but if they don't then they MUST give 30 days pay.
Of course, this is only for people who have been working at the company for 6 months or more. Less than 6 months, and such labor protections do not apply to you. The employer is not obligated to give you 30 days notice or 30 days pay to you in such a case. |

| YoungFrankie looks at the question here accurately it seems, the employer seems obligated to give a month's notice or a month's pay. What's the problem? this seems to be the law. Many of us westerners think obeying the law is an obligation, not just a good idea. |

Was the reprimand official and tied in with something stated in the contract about dismissal?
As far as him giving in his resignation. He may have wanted to leave in three weeks but he didn't follow through with leaving them high and dry or even hang the possibility over their heads. So then they fire him in retaliation. Now, are you claiming that this is the justification for him being fired, or is there more? |
