Hi I was offered a 10 month contract with a private high school in Budang. They are offering a 10 month contract because the school does not to provide paid winter vacation. However, here is a more important problem. I am worried about severance. The contract states that a one-month severance will be paid at the end of the contract. However, I know the Korean law states that severance only has to be paid if the teacher is employed for 12 consecutive months.
So can the school try and screw me out of severance pay even though it is written in the contract? |

Have the wording of the severance payment clause written specifically say that you will receive a on month's severance payment even though the contract period is for 10 months.
Don't just have it written in as a standard severacne payment clause because if you have to go to the labor board to fight for it, it could go either way but if the wording is very specific it should go in your favour. |

good idea. I didn't think about that. If they refuse then I'll just walk away because I think the school has something to hide. Afterall, I am just asking them to keep their end of the deal by writing the conditions on paper. I know better than to trust Korean verbal promisses.

i agree, make it worded right, perhaps even change the wording away from severance bonus to something like "completion bonus." that way, severance laws cant be used to hurt you.
also, do you want a ten month contract? that is pretty shady, you are losing two months of pay because they dont want to pay you. i would think about that if i were you. and i personally wouldnt do that, but i guess it depends on your plans and how much money you need.
there are plenty of schools that can give you a 12 month contract, guarantee a severance pay, and not have you work during vacations, just find the small schools outside of the big cities. so unless this school has something you really want, really consider that... |

Not over there yet, but I just filled out a shitload of "give me information" forms online, and had a fair number of agencies that looked legit contacted me in <24 hours.

they lied to u. it has nothing to do with winter vacation what so ever.
they dont want to pay the bonus and are trying to think of ways to
get out of it. 100% they will say at the end of 10 months that u didnt work 12 months |

They never lied to me. Also,I don't work at the school. I am saying that I am offered a job with a 10 month contract at a private high school that runs from March 2nd until the end of December. Iwas informed that the school would pay a completion bonus even though the contract is only 10 months. I will be meeting directly with the school on Tuesday. I know it sounds a bit shady, but I want to know what to do in order to get the school to stick to their word. Trust me, I will not believe what the school says. I want this on paper, but I want it worded in a way that supports me.
Changing "severance" to "completion bonus" is a really good suggestion.
If the school won't agree, then I'll just walk away. I have nothing to lose, but an hour of my time. |

i didnt say u worked at the school.
im willing to bet u a months salary that after the 10 months, u wont get the bonus |

I am worried about that too, which is why i want it worded in the contract so they have to legally pay it to me.
BTW can you get a 10 month e2 visa? if they pull any of this obtaining multiple c4 visa crap I'll simply walkout. |

its not impossible to get an E2 for 10 months. I had one for 11 but my first school let me go a month early by mistake lol |
