Hey,
A friend of mine will be leaving to country this June and he asked me if his Visa would become void upon leaving the country. I wasn't sure what to tell him.
He re-signed with his hagwon last December... pretty good place and he's on good terms with his boss. But he's got a few weddings to go to, which is why he's going home. Upon re-signing, he told his boss there was a very good chance that he may leave in June... The guy said "OK". Here's the hang-up... my buddy is going back to school in September, so there's no way he'll be coming back to finish up his contract, but he wants to work a summer camp (only coming back for a month+... obviously, he wants to make some $). Does he have to bother getting a letter of release? or can he spare his manager's feelings and just have his Visa cancelled as he leaves the country, then apply for the camp Visa thereafter?
His manager has been a solid guy so far, but he's not sure how the guy will react if he knows that my buddy's gonna cut contract to work at a summer camp.
I told him: I think that as long as his boss doesn't report him as a runner when he leaves the country, he can cancel his current Visa and carry on applying for other jobs, worry-free. Am I right? wrong?
Anybody know how to go about this?

Why would your friend screw over one of the few honest people in the ESL industry in korea?

Wait a second here.

Is your friend going to tell the boss that he is not coming back to work at the hakwon or just leave him in the lurch?

Good question Ya-ta. I have zero sympathy if he's leaving him "in the lurch".

Dude, yer 'firend' should be clear to the boss regarding his intentions. At least give him a chance to replace him.

If he wants to do the camp legally (ie. get a work visa for the camp), then yes, he needs a letter of release.

A visa cannot be cancelled simply because you left the country. A letter of release is needed to do this.

So tell him not to come back for the camp then. Is he really that broke?

Sorry but you are wrong. If the camp tries to apply for a visa in his name before his current contract expires in December, a red flag will pop up at immigration and the visa will be denied. In order to prevent this, the current visa must be cancelled with a letter of release. As I said, simply leaving the country doesn't do anything. If the visa hasn't been cancelled then it is still active and you can't get another one.

Two morally correct choices:

a) tell his director

b) don't come back to work at a camp

Morally incorrect choice:

a) screw the director

Like I said, when he finished his first contract he re-signed. While negotiating his 2nd contract, he told his boss that his plan was to leave in June... the boss said 'no prob'. He's not leaving his boss out to dry... come June, his boss will have had 6-7 months notice. Regardless of whether or not he does the summer camp, he is going home in June and ceasing to work at the hagwon, AS VERBALLY AGREED.

J.B... thanks for the info. I just thought that it might be OK because a different friend of mine was getting HOOPED by her hagwon back in '04. She said that's what she did... she spent a day or two in Japan and when she came back, she was good to go. She said it was a gamble, cuz if her original hagwon had reported her as a runner, she would have been screwed... but they didn't. Maybe she left out some details. Sounds a bit too easy.
