My apologies if this question has been answered elsewhere. I tried searching for an answer to this, but so far I haven't been able to find anything.
I'm wondering if there is a law somewhere that requires hogwan owners to pay employees for national holidays and vacation.
I didn't realize until I got here and looked at the monthly schedules and pay dates that they had arranged things in such a way that all national holidays and vacation is UNPAID. This school is very generous with time off (I wonder why), so it means that I lose more than a month's pay over the course of the year as a result.
It's my own fault for not noticing that the word "paid" was missing from the contract. It really sucks because my last contract paid me for all these things and I'm really kicking myself for not noticing this.
Anyways, I'd just like to know for my own information. |

I don't know for certain, but I'm pretty sure it's the law that national holidays are paid and that you have to have a set amount of paid vacation days separate to that.
I've been here since March 05 and have lost at least 7 days of national holiday vacation because of the mother loving holidays falling on weekends.  |

If it is a red day and falls on a day when you would regularly work you are entitled to your money...
However if you have a moving shift every week, like Sunday to Thursday and next week Tuesday to saturday and it changes each week I suppose with creative timetables that could get away with it
Also you are entitled to 10 days PAID vacation a year.... |

its seems that the practice is for schools to insist that the 10 days vacation be paid out at the end of the contract
essentially this means any kind of elective holiday is a no, no
any time i've tried even to get an hr off they've errupted, i did get 4 days off to go home over xmas must basically had to threaten to resign to achie

While i do know this does happen i don't think this is a common practice...
I have worked at 4 different schools and never had much problem getting all my holidays when i have wanted it(within reason)..
Of course the umm and ahh but they get over it pretty quickly...
If you work by yourself it can be a bit more a battle but if they refuse I would go anyway and say I'll see you next week....they won't fire you as it is such a hassle to replace you. |

If the national holiday ( a Red Day) falls on what would otherwise be a regular work day, it is a paid day (ie. holidays that fall on weekends are not paid).
Lawfully-required vacation (10 days) is also paid. |

Thanks for your responses. I managed to find a section in the Korean Labour Standards Act about the 10 days of paid holidays. However, I haven't been able to find anything about national holidays. Does anyone know where I can find from some sort of official source (like a law or government website) that national holidays are to be paid?
Someone mentioned that a lot of schools will pay the holidays at the end of the contract rather than actually give you the time off.
What my school does is they give everyone time off at the same time and close the school. However, they pay at the end of every session, which lasts four weeks. So, for example, we got a week off at Christmas and we had to wait five weeks for our pay instead of the usual four. Similarly, we had two days off this month for the Lunar New Year, so instead of being paid this Friday, we will be paid next Wednesday to account for the holiday.
I noticed that this sort of shifting pay date goes against the Labour Standards Act as well. You're supposed to be paid on a specific date each month.
I'm starting to think that every hogwan in Korea will try to screw you out of something! |

Call Labor at 1350. Ask them.
