Supreme Court Rejects 'Lolita Syndrome' Defense

The Supreme Court on Tuesday sentenced to life imprisonment a serial child rapist who had earlier won a lesser sentence on claims that he suffers from so-called �Lolita Syndrome.� Supreme Court Justice Ahn Dae-hee overturned a Seoul High Court sentence of 15 years for the 39-year-old defendant identified as Lee for raping 12 schoolgirls from nine to 13 years old.
The Supreme Court said that Lolita Syndrome, or pedophilia, itself was not a valid reason for the sentence reduction. Justice Ahn questioned the severity of Lee's condition, citing the facts that Lee had never sought treatment for the condition and is married with two sons.
Lee raped the elementary school girls in rooftops and storage areas from Nov. 2005 to Jan. 2006. He was arrested while searching for his 13th victim. In his first court ruling, Lee was handed a life sentence based on the terrible damage inflicted on his victims and the fact that he deliberately planned his attacks, even surveying appropriate crime sites and wearing a cap to avoid identification by CCTV.
Lee pleaded for a sentence reduction in the appellate court claiming that he had developed Lolita Syndrome after being raped by his father at a young age. The appellate court reduced his sentence to 15 years in consideration of the mental illness behind the pedophilia.
