I have been working for my school just a few days shy of 9 months. I have just been told by the school manager that the boss/owner wants me to leave as the school can no longer afford me. The owner intends to take over my classes. I know the school has been in financial trouble for some time-that is not in question.
I am still waiting for my Feb. pay which is 9 days late as of today. I am having a meeting with my boss today to discuss my leaving-of course I will ask that I be paid for my last months wages immediately. I will also ask for a written notice of dismissal-30 days notice -according to the labour standards act. I will ask for an LOR although intend to go home for the summer, returning to Korea in the fall, at which point my contract in question would be well over anyway. I believe I need to go to immigration with my boss to terminate my work visa at some point. I believe I need to get a copy of the Receipt for Wage and Salary Income Taxes for 2006 and 2007 for tax purposes in Canada over the next two years.
Please tell me if I am forgetting anything. What happens with my ARC card? Does immigration keep it or is it handed in at the airport upon leaving.
I know I will miss out on severance pay etc. but honestly, the stress of staying at this school is not worth it. I am going to see if I can get a plane ticket though, even though I know that legally I am not entitled to one. |

He should pay for your flight, since you've been there for six months. It's his responsibility.
This could get messy, as he might just not pay you. To get your money, you'll have to stay in Korea for at least a month and wait for the Labor Board to act. You would eventually get it, but at what cost?
See if he can at least pay part of it, and cut your losses.
As for your ARC, they will either take it at immigration (probably) and give you a piece of paper/exit order along with a stamped "leave by" date in your passport, or you should hand it in at the airport when you leave. You would just tell the immigration guy that you're leaving and not coming back. He'll keep it -- no problems. That's what happened when I finished with my first school. |
