I am currently on my second contract in Korea teaching English. In my first contract, I was under the impression that I had health insurance. In fact, it was stated as such in my contract:
"4.8 HEALTH INSURANCE : Employee shall be covered by medical benefits under the Medical Insurance Company. The cost of this coverage shall be paid half by Employer and half by Employee. Payment will be made by deduction from Employee's basic salary."
I assumed this was the case, and that I had health insurance.
Now, upon starting my new contract, I have been informed that there is no record of me with the NHI. I know now in retrospect (after asking questions) that I should have received a card (which I did not receive.)
So, I'm stuck paying the full 700,000 won for last year's coverage that I never received, as well as half for this year with my new contract.
The language in the contract is completely unambiguous ("shall be covered"). Is it possible to have them pay for the insurance they neglected to provide me with retroactively? The contract is finished and I have a bad feeling I'm effin' farked on this one.
Any ideas?[/b] |

If they didn't pay health insurance, they probably didn't pay pension either. Were they making the deductions from your paycheck? |

If they didn't pay health insurance, they probably didn't pay pension either. Were they making the deductions from your paycheck? |
Unfortunately, they didn't give me adequate records to look back through and figure that out... (pretty common over here to not get a monthly payslip complete with deductions, eh?)
I don't think either were paid... |

That's kind of what I figured... I composed a letter to the director of my previous school invoking their better nature, but it's a futile effort I'm sure. At least I can take comfort in being able to inform all of their current employees about their legal rights concerning medical insurance. I talked to one of them and they've been told by the school that "they already have medical insurance." Total B.S.
Would the labor board deal with such issues, or would we have to deal directly with NHIC? Any clue? |

You would have to deal with NHIC and perhaps a civil suit for the 700k but your chances of getting anything are not good.
Revenge is best served cold.... publish the school name and address. |

I would not advise standing outside a hakwon with a poster board and protesting. That will get you into trouble.
Bad mouthing them here is an international sport and is anonymous.
You can also use places like the hagwon checklist to be as specific as you want. http://www.hagwonchecklist.com/
Informing your old co-workers that they are being cheated would also be an interesting thing to do. |
