This is a long sticky situation but ill give you the short of it. My contract states: If the employee leaves the school before six (6) months, the employee must payback the initial airfare or the employer may deduct the amount of airfare from the teacher's last payment.
Well, I gave my notice before the six months but so that I would be leaving after the six month mark. I was told I would have to wait to give my notice until after the six month mark. Does this make sense to anyone?
The date is quickly approaching and we are still haggling with no compromise insight. Basically the head office is saying there is a general company policy thats vaguely cited at the end of the contract and that I've never seen that requires teachers to give notice only after the six month mark. But my point is the contract states in plain language that only LEAVING before six months will incur the penalty and includes no language regarding when the employee must give his/her notice. So far no one will answer my question and instead just refers me to someone else or the company policy which they then refuse to produce so that I can read it. I'd appreciate any advice/insight any vets out there might have. Thanks.

If you gave your notice on 5th month and leaving after 6th month, you don't owe them anything.

They're trying pull a fast one on you. Contact the labor board.
