I've almost finished my contract with this hagwon, and i've been complained against by some parents for the use of disclipine in the classroom. Just today I received a threat by the supervisor if i'm to do it again they will not pay my severance and return airfare... Its actually funny, both the owner of this school and the supervisor have another korean teacher to tell me what i supposedly did wrong. Can anybody tell me whether that threat is legit? (read below) Is there anywhere I can get good legal advice around Seoul in case something happens? Here is what it says about the dismissal part of the contract, please post your thoughts...
11. Dismissal
The employer and employee agree that this agreement is fully legal and binding under the law of the Republic of Korea and may be terminated by the employer at any time should one of the conditions arise:
1. The employee or any his/her dependents act in violation of Korea law.
2. The employer discovers that any documents or information provided by the employee regarding his/her credentials or qualifications for employment have been falsified or deliberately fabricated.
3. The employee conducts seriously jeopardizing any student or staff person or has drug, alcoholic problem.
4. The employee�s class enrollment drops below institute�s average enrollment for the three consecutive months.
5. The employee has private lessons even in free time either before or after work. |

Technically you can't be dismissed for discipline, but there are always other excuses to get rid of you.
My suggestion is to not discipline the kids. Just show up for your paycheck, and let them get away with anything. Besides you're almost finished with the contract.
I was told by my boss that I was too strict because I made some kids stand up, and I ejected another from the classroom (on separate occasions). Hagwon owners are afraid of parents quitting, so they don't want the teachers to discipline the kids. I've resigned myself to the fact that I'm not paid to teach. I'm just here to babysit, and market the school with my white face.
Getting a lower level employee to relay a message from the boss is quite common in Asia. I received this treatment in Japan and Korea. |

Your kid has not improved because he doesn't pay attention in class and screws around. Your continual pleas of "Johnny please be quiet." and "Pay attention!" fall on deaf ears.
The few kids who do behave and improve might be enough to vindicate you if that argument comes up.
If this is the only problem that has come up since you've been working, I wouldn't do a runner. You definitely won't get your bonus and airfare if you do that. And then you'll have no legal recourse if you choose that avenue. |

Are you leaving Korea for good?
If so, let them know that you want to stay and that you want the same money as last year. All they then need to give you is a 2 week (unpaid holiday) along with round trip airfare home so that you can visit family. Oh and you need your severance for our spends...
They will be happy to save recruiter fees, won't bother to advertise and when they discover what you have done it will be too late for any damage control (eg, refunding the return portion of your ticket, etc). |

Or it will teach them that foreign teachers won't put up a fight and run with their tale between their legs saving the school a few million won in severance , airfare and possibly some salary.
OP, just bide your time and get out after the contract. I would try to find out exactly when you are to get your severance and wait in Korea to get it. |

99.9% huh? Golly. Where do you get that stat?
Koreans get screwed just as badly in the hagwon industry as the foreigner. |

| 1 and half months left. Yeah just suck it up and be a good little surf. If they try to keep the severance and airfare get on the blower to labor. The labor board frowns on these 11th month sackings, they know exactly what the hagwon is up to. |

If they didn't like the way you were doing things ask them why they decided to let you know 1.5 months left of your contract?
Best thing is to bolt as fast as you can and do it in a way that leaves the school stuck looking for a last minute teacher. Unfortunately you may have to walk out on your kids but at least it might teach them a lesson not to *beep* with us. |
HELL NO!! This is the worst advice in the world. Finish at all costs to get every single won you should get. Do not run now..it is almost impossible for them to not pay you everything. You can go to the labor board easily at this point. |

Banging a small wooden stick on the table, threatening kids (throw em out the building, but they know the window is too small to do so), yelling my lungs out, telling kids if they misbehave they are to go outside of the class etc...
by the way, i attended the franchise's conference earlier in the year and they said we could use any means providing we don't harm the child of course.. |
