Ok, so i'f i'm 5 minutes late for prep time, can they legally deduct from my pay? They gave us a swipe card today to track us..... |

Is said "prep time" in your contract? What does the contract say about being late? |

Deduction from the monthly salary will be made for any absence other than the above paid absence of illness. Deduction amount will be decided by the hours, and/or days of absence and tardiness
Ok maybe they got me. So one minute could = an hour?
hey does anyone know about these "personal days" that we have by law? |

does your contract say what time you must check in? if it doesnt, and you are late, then cant you just stay five minutes after class as your "prep" time and be fine?
and if your contract doesnt say anything about swipe cards, just refuse to use it. |

Try acting like a professional and report to work on time, if not earlier.
If by accident you should be late a few minutes, call in ahead of time and tell your director/boss, he'll appreciated the heads up and if he gets too annoyed, he will tell you that you wont need to do that in the future.
Then again, dont aim to bombard him with your calls for being tardy, but aim for being at work on time. |

I'm so not going to call if I'm a few minutes late for prep time.
I used to make up my late minutes at the end of the day, on my own. No one told me to. And since no one ever said anything about the fact that I was 5-10 minutes late every single day, I suspect they never looked at the logs. |

Um, if you are contracted to start work at a certain time, and you are not there at that time, they can dock you the money you were not there. That is not a penalty clause. ie contracted to start work at 3pm, but you get there at 3:30. They can legally deduct that 30 minutes from your wage (whatever that works out to; you'd need to know your hourly wage)
A penalty clause is different (and you're right, they are illegal). If the contract says "If you are late without reason, we can deduct one day's pay from your salary" THAT is a penalty clause. In the above example, they CAN deduct the 30 minutes, but they CANNOT deduct a day's pay. Just as they cannot say "If you resign, we will only pay you 70% of your salary until you leave" (yes, I've seen that in contracts. That would also be a penalty clause.
In the OP's case, if he's 10 minutes late (and makes, say 18,000/hr), they CAN deduct 18,000/6=3,000 from his wages, but they can't say "Well, you're late, so you owe us for a full hour" then deduct 18,000. But if a school is petty enough to keep records like that down to the minute, I would resign and find another school that isn't so anal. |

Getting an hour docked for being 2 mins late sounds like a penalty clasue to me. If you're 30 mins late...
What's the fuking point of even replying. Someone is just going to whine and bitch anyways. |
