I took a contract, the owner lied about teaching duties e.g. kindie, split shifts lasting from 8 am to 8 pm some days. Very bad and dirty apartment, no other foreign teachers...even though I was told different before I arrived. I Decided to break contract because of a legitimate illness with my mom so, the owner escorted me to immigration, I obtained a LOR, departed the country within the two week period as I was instructed. I forfeited my last months salary because I worked as a slave less than the 6 month requirement, but when I returned home I was informed by e-mail that I still owed her money (she was very angry I left due to the parents of students had already liked me very much, and I was the 3rd teacher in 1 year that she had hired and quit) I forfeited more than 2 mil, and never got paid the OT promised to take on more classes. I am going to return to Korea under very different conditions very soon. Can she do anything to prevent me from getting another E-2 visa even though she gave me a LOR and my previous visa was cancelled?

Yes. If you skip out, she can call up immigration and have you blacklisted. What that means depends up to immigration. If they want to blacklist you for a year...or two...or indefinitely.
However, with a LOR, I don't see how she could really do anything.

| In my opinion, once you got your LOR and visa cancelled, there's isn't a thing that they can do to blacklist you. So I wouldn't worry about it. Your ex-boss is just BSing. Write her back and tell her that you're not going back to Korea and she suck. |

| I understand that if I just pulled a runner there are consequences to that sort of action. But I accompanied my boss to immi, cancelled the visa, did what immi instructed me to do. Shouldn't the LOR be the end of my era with her, irregardless of what she may say after the fact? |

Yep! When your visa is cancelled and got your LOR, you are no longer tied to your ex-boss. You are no longer her slave. You are free. |

So you technically GAVE her more than 2 million won that she is not really entitled to), and you STILL owe her money? Tell her to pay it with the salary she kept from you because you're not coming back to Korea.
You've got your LOR and your visa was cancelled in person, so she can't blacklist you. Immigration only concerns themselves with Immigration law. They don't give a rat's ass if you've been ripped off with severance, or pension, or the boss didn't pay your salary or you didn'y pay your phone/CC bills. It's not their concern as they see it, until and unless they get something from small claims court saying to put a halt on your passport until you pay up (but that requires the boss suing you).

3 in 1 year, eh? Doesn't surprise me that she can't see the reason for that is herself. |

I hired 2 teachers who DIDN'T have an E2 visa with the school that was jerking them around. We went to process their information, and the RECRUITER had called immigration because of an outstanding balance owed because of airfare and recruiting fees. Essentially they were offered a position, were flown here and when they got here they were told there was no job for them. They waited 2 weeks, hoping that the recruiter would find something, and he didn't. So they went off on their own, and found me.
We struck a deal with the previous school, and offered to pay for the plane tickets, so long as the recruiting fees for their first placement were waved. They agreed. However, this left the recruiter without his money. So he got mad, called immigration and listed them. "I own you," were words he specifically said to the teachers. In the end, immigration wouldn't remove the block until he received his payment.
I guess what I am trying to say is, even if you have no E2 visa, if your previous employer is mad enough, they can put a block on you for outstanding fees. You can always try, and see what happens. Your new employer will find out rather quickly if a block has been put up on you. |

Do you actually need a letter of release when you apply for a new position? I had my current visa extended for a year even though my boss and I had agreed that i stay for an extra month. He promised he would cancel my visa once i left.
Any help would be great.

Immigration can be tricky, so even if someone on this board posts what they think is 100% true, you just never know until you contact your local office. Many of the local offices make up their own rules as they along. |

In reference to your question Screwdriver:
When your visa was extended for the year by your current employer you are connected to school for the next year. You should without a doubt have the director accompany you to immigration to cancel your visa and get a LOR when the month is up! Especially if you plan to get another job after the month is over.
Don't take the chance that everything will work out...fortunately l have been given another visa since the last message posting. But I would not have been issued it if I did not secure the LOR. Always err on the side of the law and caution!  |
