I received this contract from Kids Club. Could anybody tell me if this is decent or not? Any thoughts would be greatly appreciated.
Letter of Contract
The Board of Directors of LCI Kids Club Language School (LCI Kids Club) and _Joseph Raicovich __(the Teacher) agree to a contract for regular full-time English teaching as follows:
TEACHER BENEFITS
A. Salary
Payment for 120hours(1hour is 60min) worked in a teaching term is (1 term is 4 weeks/20 days) 2,200,000Won. The salary will be paid per term on the 10th of the following month. The first month�s salary will be based on the number of days worked (60,000won per day of payment will be given to employee for the duration of the orientation/training).
B. Overtime Pay
All teaching hours in excess of 120 teaching hours are considered overtime. Overtime will be paid at the rate of 18,000 won per hour. The teacher may be required to teach overtime. All instructors are required to substitute for other teachers who are sick or absent.
C. Pay Deduction
Teachers will have three paid sick days only with the doctor�s diagnosis. LCI Kids Club may deduct a day�s pay for each day teacher is absent from work for other reasons except for illness or inevitable reasons or teachers used all the three paid sick days. However, if teacher does not arrive on time after vacation, LCI Kids Club may deduct two days� pay per day.
D. Housing
LCI Kids Club will provide every teacher with a single house. Furnishings provided by LCI Kids Club for common use include: a kitchen table and chairs, a gas range, a refrigerator, a telephone, a television, and a washing machine. Furnishings provided to each teacher include: a bed, a wardrobe and a fan.
The cost of monthly service, utilities and telephone charges for the accommodations provided will be paid by the teachers.
E. Airfare
LCI Kids Club shall pay round-trip ticket between North America and Korea. In case the teacher fails to complete the contract by his or her own fault, the teacher shall pay back to LCI Kids Club the total amount paid by the School for the airplane ticket.
F. Severance Pay
On completion of one�s responsibilities of the full contract period, One month salary shall be paid as severance pay.
G. Vacation
Two weeks vacation is offered. One week during the School�s summer vacation and the other week during the winter vacation.
H. Teacher Training
Before starting to teach, the teacher shall have 2~6 days of training. During training, he/she will be paid 60,000won per day.
TEACHER OBLIGATIONS
A. Supervision
The teacher will work closely with program supervisors and other colleagues in the planning, observation and review of instruction. LCI Kids Club will observe teacher�s class informally for help at any time, and formally according to a given schedule for evaluation of teacher.
B. Behavior
The teacher should respect the rules and standards of conduct of LCI Kids Club (written, verbal and tacit) and obey the laws, regulations, instructions, and ordinances of the national and local governments.
The teacher is required to be punctual, reliable and most of all professional in representing LCI Kids Club.
C. Workload
The teacher will teach usually about 30 hours per week for a total of 120 hours per teaching term.
In the event that the actual number of teaching hours scheduled for any particular teaching term is below 120 hours, the teacher will be required to devote the remaining hours to related academic work under the supervision of the academic coordinator.
Staff meetings and school events will be scheduled at the discretion of the institute director. Attendance is required. Staff meetings will allow time for discussion of topics of current concern within the program such as new policies, procedures, methods of training, instruction, curriculum and other matters as needed. Staffs are encouraged to help work out practical solutions to problems at these meetings.
D. Work Schedule
The workweek runs from Monday through Friday. Hours of operation are from 10:00am to 7:00pm. The teacher will be scheduled to teach during this time period by the School Director.
The teacher is usually, though not necessarily, scheduled in shifts.
GENERAL
A. Taxes
South Korean income taxes will be withheld automatically from your monthly salary. Income tax on the monthly salary runs at about 4.4%, and on the severance payment around 1-2%.
B. Termination of Employment
If teacher is absent on three occasions without notice, LCI Kids Club reserves the right to terminate his agreement by issuing teacher written notification of termination thirty days in advance. For serious causes, termination of employment with LIC Kids Club is immediate and without notice. Serious causes include the following:
? drunkenness on the job ? sexual misconduct
? outside employment ? irresponsible working
Kid Club reserves the right to terminate this agreement for cause with written notification sixty days in advance, and for serious cause without notice. The teacher agrees to give written notification sixty days in advance of intention to terminate this agreement or of interest in renewing it.
C. Contract Period
2007_July to _July 2008_. If the contract ends in the middle of the term the teacher agrees to teach until the last teaching day of that term. I have read and agreed to the terms and conditions of employment as an English teacher at the LCI Kids Club Language School. In signing this mutual agreement, I understand fully my responsibilities at the LCI Kids Club Language School and accept the position on the basis of the job description in this contract. |

120 full hours in the classroom (7200 contact minutes) for the same money as the next hakwon monkey working 6000 and a public teacher working 3700. That 1200 contact minutes extra per month means 20 (or more) extra hours in the classroom for free.
It just gets worse after that.
FAST PASS on this one. Leave it for the next sucker. |

Your employer is UNDERPAYING you per day during the first (1st) month of employment. Many employers pay their employees according to the number of days worked during the first month of employment.
Calculation of daily wages
Annual salary (26,400,000 Korean Won) divided by weeks per year (52) = 507,692 Korean Won
507, 692 Korean Won are your weekly wages
In order to calculate daily wages you would divide your weekly salary by the number of workdays per week (5).
Daily wages = 101,538 Korea Won
B. Overtime Pay
All teaching hours in excess of 120 teaching hours are considered overtime. Overtime will be paid at the rate of 18,000 won per hour. The teacher may be required to teach overtime. All instructors are required to substitute for other teachers who are sick or absent.
(1) I don't agree with "required overtime" because there have been far to many cases where employers have not paid employees overtime in Korea. That's my two cents worth.
(2) The overtime pay is low and your employer is paying you a hair above hourly wage. Bump up the overtime pay to 22,500 Korean Won per hour.
Annual salary (26,400,000 Korean Won) divided by weeks per year (52) = 507,692 Korean Won
507, 692 Korean Won are your weekly wages
In order to calculate hourly wages you divide weekly wages by the number of hours your contracted to work per week (30).
507,696 / 30 = 16,923 Korean Won
You calculate overtime wages by hourly wages x 150% or 1.5
16,923 x 150% = 25,384 Korean Won = overtime wages
C. Pay Deduction
Teachers will have three paid sick days only with the doctor�s diagnosis. LCI Kids Club may deduct a day�s pay for each day teacher is absent from work for other reasons except for illness or inevitable reasons or teachers used all the three paid sick days.
However, if teacher does not arrive on time after vacation, LCI Kids Club may deduct two days� pay per day.
This contravenes labor laws

Your employer is underpaying you at the rate of 60,000 Korean Won per day as this should clearly be adjusted.

(1) There is no mention of a break that you're entitled to use freely.
(2) No contractual language that clearly defines a work hour.
(3) There are no clearly defined work hours as they are NOT the same of hours of operation.

Income tax isn't withheld according to a fixed percentage as many employers still write this in labor contracts. Yes, income tax is deducted from severance pay. It isn't deducted to a fixed percentage as I stated earlier.
B. Termination of Employment
If teacher is absent on three occasions without notice, LCI Kids Club reserves the right to terminate his agreement by issuing teacher written notification of termination thirty days in advance.
For serious causes, termination of employment with LIC Kids Club is immediate and without notice. Serious causes include the following:
drunkenness on the job
sexual misconduct
outside employment
You can work outside the place of employment if you have permission from your employer and Korean Immigration Officials.
irresponsible working
Vague contractual language. Irresponsible working is certainly open for inerpretation.
Kid Club reserves the right to terminate this agreement for cause with written notification sixty days in advance, and for serious cause without notice. The teacher agrees to give written notification sixty days in advance of intention to terminate this agreement or of interest in renewing it.
FYI: If your employer doesn't provide you an Advance Notice of Dismissal (provided exceptions don't apply) then he or she has to pay you wages of greater than 30 days. In your case it would be wages of 60 days!

2007_July to _July 2008_. If the contract ends in the middle of the term the teacher agrees to teach until the last teaching day of that term.
Year day, month should be clearly defined before signing. You are in a position here to work past your contract term if it ends in the middle of the term. You CAN'T work past your contract term date unless you jump through the hoops at immigration.

Where's the pension? At a Kids Club, a teacher may not get the legally required pension and health insurance. Kids Club is a hogwan chain that routinely cheats foreign teachers out of benefits. This is a bad deal from a bad chain hogwan. Stay away. |
