Just decided not to recontract with my public school with only about three weeks remaining in my contract. I had previously told them I intended to recontract but because of an increasingly impossible situation with my co-teacher recently, I've just decided I cant face another year.
My co-teacher handed me a resignation letter that I 'have' to sign today. My point is I didnt resign, I just told them I changed my mind. My question is whose side is the law on with regards to return airfare and severance etc?

Have you signed a new contract yet?
If not, just complete and walk away. Tell you co-teacher to politely stuff it. |

No mate. Havnt signed anything else. What consequences would signing a new contract have, if any?

If you had signed a new contract they may have applied for a visa extension which means you'd need a LOR.
Don't sign anything that has resignation on it. Although your school may ask you to sign a document that states your intention to re-sign or not re-sign.
If your co teacher is being rude, tell her to wait. Go and talk to your EPIK/GEPIK/SMOE coordinator. |

I take it you mean if I had resigned with the school I'm at now I would have had to have got a LOR? Yes, I knew that.
My co-teacher and I had a god-awful argument this morning. Was the result of months of simmering tension. Shortly after he told me I 'had' to sign this damned resignation letter.
Actually I dont even know who my GEPIK co-ordinator is? I'm in Kyounngi so maybe is Wenise Kim?

Why don't you just re-sign w/ GPEK and ask for a new school? Don't sign a letter of resignation simply because you're not resigning. |

Do not, not, not sign that letter. Just tell them that you don't need to because you're contract will terminate itself.
If they really need something, type up your own 'letter of intent' in which you merely state that you do not desire to renew your contract. |

Now theres a thought......lol.
Thanks for your thoughtful and useful replies. I just threw the resignation letter in the rubbish bin...best place for it I think! (Heres a thought....wonder what would happen if I signed the resignation letter but dated it for the day my contract ends in 3 weeks??).

Don't sign it.
As others have said you are not resigning, simply working out your contract till the end and not re-signing.
If you were to sign a letter of resignation then, if you were going home, the school wouldn't have to pay your return airfare.

My co-teacher is going to America some time next year. Maybe after he's been there for a while he'll realise what its like to be the odd man out in a system where your in a minority of one and theres no support and no-one to fight your battles for you except yourself.

I think so. You have to have worked a full year at a school to receive severance.
