korean friend with a libel problem.

this friend of mine is in a pickle and is convinced she's going to fry.

she is in a group of friends that number about 15, and she's gone and offended the oldest female in the group, which has made all her friends turn on her.

the oldest female, we'll call her "d", being a not very attractive, jealous and vindictive person, regularly talks judgemental trash about the younger, more attractive women in the group. at one point she called a girl a "wh*re" for dating a guy she didn't approve of. behind her back, to my friend. it's childish jealousy pure and simple, but because she's the ajumma of the group, she gets away with it.

bear with me, this is the part where it sounds like high school, only performed by people in their 20s and 30s...

what happened is this. my friend "s" got a little tipsy a couple of weeks ago and after being fed up with another of onni's trashtalking tirades wherein she attempted to get "s" to stop being friends with her best friend, "s" goes and tells "sh" that "d" (onni) called her a wh*re.

"sh" of course gets righteously p.o.'d and leaves a malicious message on "d"s cyworld page. "d" reads it and hits the roof.

now here is the deal. "d" has no physical evidence that "s" told "sh" what she said.

last night "d" met with "s" to try and solve the problem. she said that if "s" doesn't give her 3 million won, she's going to sue her for libel. "s" is convinced that she has to pay it, or else she will get sued, and in turn, lose her job as a public school teacher.

the only thing that "d" has is people's testimony. she has nothing printed, nothing from cyberspace, only what people are saying about "s" and the fact that she told "sh" the truth about "d" calling her a wh*re.

unfortunately, she's bullied everyone in their circle of friends into railroading the poor girl who made a minor mistake and told too much truth when she was intoxicated.

anyone out there heard of similar legal kaffufles? what do you suppose "s" can do to defend herself?

If grown women can act so grade school, tell "s" she's missing nothing by breaking off ALL contact with everyone and getting new friends. Especially, break off with "d"... she has no proof. Stop listening to "d" and ignore all contact. Force "d" to file a lawsuit. She won't get anywhere when she has no proof. And truth be told, the whole libel/slander deal is just bluster on her part. Those with the biggest mouths usually have the smallest balls.

this is precisely what i've advised her to do. it all sounds like blowing smoke on the part of "d", and as far as "s" is concerned she has no friends anymore.

but what i don't know about korean libel law - which seems really weird compared to western law - does hearsay stand up in court? the only evidence is hearsay, and "d" has bullied all their friends to stick up for her side, even "sh", who was the one who was originally insulted.

So let me get this straight. S told Sh what D said (which was the truth NO?) and now D wants to sue S for telling the truth. Hmmm...I think we should just let D and Sh brawl it out b/c the real problem is between them and doesn't even have anything to do with S. Sh should be sueing D for calling her a W.

unfortunately, and this is a new development... d had orignally wanted to sue sh, since she's the one who left the virulent message.

but then they got together behind s's back and worked out their problems. d assured sh that what s said was all lies, and now sh is one the warpath for s too.

yeah. utter horse-shit.

'S' is not guilty of libel since she didn't write anything.


Isn't 'D' breaking the law by trying to extort money?

that is what 's' is now trying to pursue. it sounds like she may be successful if she can get some proof. she's going to record her next phone call with 'd'.

Correct me if I'm wrong here, but don't you have to prove damages (financial) to successfully sue for libel?

OP- You are a woman. Obviously. Only women care about all of this "I hate her because..." and "...then she said I was too fat and she's not that beautiful and her boyfriend is cute..." blah, blah, blah. If they are your friends, then they need to find husbands or girlfriends or lifepartners or whatever else they might use to put their time to better use.

Sorry to have to break it to you that way.
