My contract doesn't finish until October but we've been working together for 2 years. The new guy is coming in 5 days and we've agreed that I step out after a 1 week transition period before the actual contract end date. How long is the grace period when you must leave Korea?

Will that grace period apply to when I stop working or apply at the end of the contract period 3 months later? What should I ask my employer to do to allow me to stay in Korea until the end of the contract period? Is there anything at all he needs to do or not do?

I'll rent my own room in a hotel. I need to get more pages added to my Visa at the American Embassy in Seoul and to wait for my Social Visa application for going to Indonesia to be processed.

If you're leaving early, your boss has to report that to immi or face a fine. That will cancel the VISA, and you will receive an exit order for 14 days.

If you're not leaving early, and if this is true I'm confused as to how it's happening, it's best to ask immi themselves as anything anyone on here says is very possibly wrong or outdated.

ASK IMMI!

actually that's the LAST thing you should do - asking immi is such a BAD idea - they will tell you whatever they want and then deny it totally - it's happened to me and others i know.

i can tell you my experience last year; i was sure i had a 2 wk grace period after my visa expired, even the Ministry of Justice said so - who is really the immigration bosses - i had visited their office once and asked - anyway, i also had things to do before leaving korea so i already planned to come back on a tourist visa and take care of those things

i went thru pusan to go to japan - immi jumped on me like a fly on sh-t - yes they did and berated me left and right for overstaying and being 'illegal' - after some insistence on speaking to someone who spoke english finally was the matter more or less cleared up and after signing some kind of statement (no copy to me and of course it was in korean) - i was allowed to leave; also come back on a tourist v no problem.

now, i DO know you can go to immi BEFORE your visa expires and ask for a 30 day extension and maybe it will cost a little money but you can get it, no problem.

also - pages for your passport - i did that, it was a wait and do now - that is, you don't have to leave your pp there, takes almost no time at all.

what's VERY important is to ask for the extension on your visa BEFORE it expires otherwise you're screwed.

btw, i did NOT have to pay a fine in pusan but they were threatening me and it was most unpleasant. i also sweated applying for a new visa this year wondering if that paper i signed blacklisted me in any way; apparently it didn't but i will NEVER overstay my visa again under any circumstances.

If you are going to leave 1 week before the end of your contract, make sure yr boss doesn't try to get out of paying severance or your airfare.

You have to be out by midnight on the day on your ARC. You can get it extended at immi if you show them your ticket out of here.
