I'll try to be impartial and straightforward as I can here.

I'm making 2.4M. My contract finishes on August 6th, but I'm flying out on July 28th because the rest of my contract is vacation.

First i was told that I don't get any money for August, because its vacation. After arguing that point, they came back and said they will pay me. However, now they will tax my severance at 10%.

On top of that, they want to pay me for only the working days during that week, not all 6 days. Which would be fine if they pro-rated a day based on 22 working days. But they're not; they are basing my daily salary on 30 days. So they seem to want it both ways.

So...am I right to complain about this? And what should I do?

Yes you're getting screwed. You should contact your local labor office.

They have no grounds to tax you 10% on the severance amount. The labor board should fully support you on that.

The other is, as you correctly point out a pro-rata 22 day month, and you'd be due the three days 1st thru 3rd for August.

It looks like they're trying to take back the August payment (by their calculation based on a 30 day pro-rata W240,000)... 10% of your 2.4 being coincidentally the same amount.

Does your contract include the provision that you work weekends? If so you'll have to accept the 30 day pro-rata. If your contract states Monday to Friday as your regular working week then again the Labor office should fully support you.

Are you leaving permanently? If so you must have the Labor office call your employer asap. If you're returning in future, you can file later at your leisure.

I would visit your local Labor office regardless, with a translator and get them to call your employer while you're there (if you say you're going to do it they may back down, but if not you'll have to go.)

Your boss is a scumbag. But what's new. They're hoping that since you are leaving the country they can screw you over with impunity. Shocked Don't let them do it. And after you've received your monies please post the hogwan's name and location on this site.
