Q1:Is the sentence right?

Joe can't go outside because he hasn't finished his homework.

Q2:Is this one better than above?

Joe couldn't go outside because he didn't finish his homework.

Each of your sentences is acceptable in its own right. In the second sentence, you may also say 'hadn't finished'.
