i am hoping someone maybe able to provide me with solid advice about my situation.
i have recently discovered that the school i am employed with, does not have permission from the state to hire foreigners. now, before someone cuts off my head for teaching at a school w/o a proper Z visa, i must tell you that i was issued a temp Z visa prior to me getting on the plane.
when it was time for me to change it into a residence permit- i was given a rushed F visa (temporarily) due to the chinese new year. Now that my F visa is due to expire, I have learned that the school's license is not complete. i have the money to leave, however i do not want to.
i love my kids and have settled into China.
is there anyway i can attain a extension on my F visa or receive an L visa? |

Confused!! What is a 'temp Z visa'?
As far as I know a Z visa is a Z visa - neither temp or permanent, which has to be changed into a RP within 28 days? of arrival.
I'm not going to cut your head off over the visa - BUT - why, oh why, would anyone want to continue working at a school that has no license to hire foreigners? There can never be any chance of your visa satus being legal, and you are leaving yourself wide open. Leave now, move on, and work somewhere that can hire you legally. |

Also never heard of a "temp Z visa" ...
Whether you love the kids or not, working on anything other than a Z visa and Residence Permit is not optimal working conditions. You need to take care of # 1 first.
You are working ILLEGALLY. The school is not qualified to hire you. They cannot get you the proper documentation. How much are you enjoying the stress, pressure and travel involved in jumping through all of the visa hoops? Do you expect the visa situation to suddenly improve if you keep working at the school?

need more info.
there is no temporary z-visa. either you had one or you didn't.
but seems you had trouble getting the residence permit. why? if
you had all the proper paperwork to get the work permit and z-visa,
rp should not have been a problem.
i suspect your school (or did you go through an agent/recruiter) used
another school's documents to get your z-visa, but were found out
when applying for the rp.
or did they get that far? they need the FEC to apply for the RP..... |

thanks for your responses.
i did not use a recruiter- i suspect that the school used another schools paperwork to get me my z visa and thought that they could get their license by the time i needed to apply for my resident permit.
when i was referring to the temp visa, i meant the one that needs to be changed into a rp within 30 days of arrival.
once i arrived at my school, i had about 2 weeks before the spring festival so we thought it be best to avoid overstaying the visa and get an F until the break was over. i admit hindsight is 20/20 and i should have demanded my resident permit, however with the time constraint, i did not want to risk overstaying the visa. now i am up the creek w/o a paddle.
the school has applied for the FEC but, has not gotten it approved yet. i consider staying because there is a possibility they could get approved and all of this will be handled.
it seems the consensus here is for me to leave and go to another school who will be able to bring me on-board legally. however- even if i successfully find a school willing to hire me, will i have to leave china and apply for another Z visa? can i do it while in the country? |

Yeah, it sounds like the school has really screwed you over on this one. Irritating that they managed to get you over on the right (z) visa and then let it lapse because of the permit issue. You did the right thing by getting onto a legal visa rather than overstaying. Whatever the case, it doesn't sound like the kind of place you want to be working for--if they can't get their act together for this then it doesn't bode well.
If you can find a new school, you will have to leave the country, apply for a new (z) visa and reenter on it. With any luck, you will be able to do this in HK or something rather than return to your home country. I would expect to have to pay for these additional expenses (trip out, hotels, new visa etc.) yourself. |

that is incorrect. you have 30 days to apply for the rp. the processing can extend past the 30 days. maybe they were thinking they didn't have
enough time to process the medical and the FEC in order to apply within
the 30-day window.

ok, so they are going to get you the fec and rp based on your f-visa?

maybe. depends on the province, the city, the school....... |

@Choudoufu- thanks for clarifying about the z visa.
and yes, currently, they are trying to get me a FEC and RP based on the F visa. however, the time frame is SLIM. i do not want to overstay my visa and then go from in a bad situation into a WORSE situation. no visa, no leverage at all. and i'll be subject to fines, etc.
i guess the best course of action is to leave and either go to HK for another visa -an expensive option or just go home (making my host school pay the cost of exchanging my ticket)
bleak outlook either way |
