|
|
I am currently in the process of leaving my job which I had been at for the May 2014 through March 2015 school year. I have a work permit but I am unsure of what the next step is to keep everything legal. Do I need to get my school to write a letter which I will present to the nearest immigration consulate that will show a non-renewal of contract for May 2015 so I can get my old work permit cancelled which will allow me to get a new work permit at my next job?
My visa is good til the end of April but I need to know how to cancel an existing work permit. Any information would be greatly appreciated. |

Hello there,
It is your school's reposibility to cancel your work permit with the labor department as your contract ends with them...your visa is tied to it so you should make preparations to leave Thailand ASAP. Good luck! |

You have a few options:
1) fly out of the country without a re-entry permit.
This will effectively cancel everything and your return will be as a tourist.
* doesn't work if you are traveling by ground. They will turn you back at the border (not allow your exit without a re-entry permit or cancellation of your WP). This is NEVER an issue if you are flying out of BKK.
2) Go to your local labor office at your convenience and cancel your work permit. If you are at or near the end of your contract there should just be a simple filling out of forms and gluing on a photo.
You then have until the next day to leave the country or be in an overstay position.
3) Let things expire naturally. You will need to cross a border no later than the last day of your permitted stay (this assumes of course that the school won't cancel your visa/WP the day after school is out for the year).

Thank you for the helpful replies. I am moving 4 hours from my current employment to BKK so I really don’t want to return to my school or local government offices unless absolutely necessary which is why I am trying to figure out what I need to do.
I am in possession of my work permit and my last day of physically working at school is March 13th. However my year long contract that I have with the school expires April 30TH. Both my work permit and my visa have an expiration date of April 30th.
So if I understand the work permit will automatically cancel on the expiration date and not cause any issues when I want to get a new one since I did not get it canceled?
Also since I am in possession of the work permit can the school cancel it?
The preferred scenario for me is just to let it expire then leave the country May 1st and come back on a tourist visa. But is there any way the school would cancel my work permit without having possession of it or informing me they have canceled it. The administration in charge of handling employer visas at my school is particularly inept so I doubt they would do it on their own since it involves them having to work. I have also heard anecdotally that when the work permit is cancelled they do not inform immigration as the government agencies don’t have the same computer network sharing personal information between agencies on teachers like myself. So to clarify as long as I leave after my visa is up immigration would not refuse me from exiting the country since my work permit is cancelled at that point?
If I wanted to cancel the work permit myself do I just need to fill out this form (file:///C:/Users/Win%208%20Pro/Downloads/wp_cancellation.pdf) and do I hand it to the local immigration department or location where I processed my work permit? Also the last page of that pdf deals with power of attorney should I pay attention to that?
I realize there are a lot of questions I just want to be sure I understand the best way to leave a job while keeping things legal. Thanks for any information posters can share with me. |

You cancel the work permit at the labor office that issued it.
You have to exit the country within 24 hours of canceling your W/P.
You cannot apply for a new work permit while one is outstanding and valid.
No worry about power of attorney. You are doing it in person and not by agent acting on your behalf.
Don't know if that is the correct form since I can't access your "C" drive.
Bottom line:
Get a letter from your employer (with the school stamp on it) that says you are finished working there and then exit the country by land without a valid re-entry permit. Everything gets canceled and you are good to go.
Fly out of the country (without a valid re-entry permit) and you don't need the letter from the employer. Everything cancels automatically.
Your other option is to return to the place you were working and file the necessary paperwork at the local labor office then you need to exit the country within 24 hours. The visa gets canceled automatically.
Wait for it all to expire and exit the country.
Do whichever is easiest for you. They all work.
