Also known as C.I.T.A advertise all the time on Dave's ESL Cafe, has anybody been able to identify who they are? Some organisations give the impression the title of their business is legitimate, professional and of good standing. It has not taken me long to work out C.I.T.A are dishonest, and conceal their true agenda. And I am assuming, I state 'assume', that they hire teachers but never place them in a legal working environment.
Every time I see them advertise they have a different correspondence e-mail address. I once spoke to an English recruiter representing them, and he would prohibit me from contact with any employees. I am starting to wonder if they are an Educational agent or recruiter. The means some organisations like C.I.T.A take to try and defraud people is very alarming.
I did a search under 'C.I.T.A teacher reviews' or 'C.I.T.A black list' and nothing came to fruition. Has anybody actually ever secured work through them? Last time I posted something under 'C.I.T.A' some one replied they are a scam. Has anything changed since then? How much money can an organisation defraud from a mendicant teacher, one thousand or more dollars? And that one thousand dollars goes to where, decorating their Chinese apartment in Shenzhen with the latest Swedish furnishings from IKEA? There are morals and there are scruples. Some people can go about life doing things unscrupulously, without hurting someone. But when it concerns morality and the moral action of defrauding one thousand dollars, where is that person with less than one thousand dollars meant to run to when they have been dumped in a cock roach infested apartment, if they can not utter a word of Mandarin? Homelessness in a foreign country is painful. I wonder if that British guy is reading this post? |

Is that the mob who run under Helen from Hangzhou? Those guys are total scammers. Was negotiating jobs with them for a short while. But every time the pay would mysteriously halve as the final negotiations were settling. Thought they could hire me for about sixty hours of work a week supervising 60 teachers and teaching twenty hours myself while being DOS - all for 8000.  |

I decided to do a search on CITA in these forums and noticed this conveniently recent topic . I haven't worked with CITA, but I have dealt with them for the past week or so.
I interviewed with a recruiter from CITA last week, and everything seemed alright. The recruiter was polite and seemed to have provided me enough details about the position... I was then provided with an offer and saw the contract which immediately revealed a bunch of red flags appearing all over the place.
1.) Recruiter states that you will be provided with a working visa, but there is no mention of any working visa in the contract. The only instance that the word "visa" shows up in the contract is here:

And that is the only clause in a 12-page contract that mentions it...
2.) The contract has the recruiter as Party A, meaning that the contract is with the recruiter, not with a school. In addition, "employer" and "school" are used interchangeably throughout the contract, making it very confusing considering CITA is the "employer." This also means that they are having you come over with either a tourist or a business visa. Whether they would have anyone working legally or not after arriving depends entirely on the schools that they contract you to (you don't even know the school yet).
In addition, there are a lot of other vaguely worded clauses... You know what? Just so people can see what they're dealing with, I'll just copy and paste the entire contract here:

家的管理规定。
1. Party A shall inform Party B of relevant laws and regulations of the People’s
Republic of China as well as stipulations concerned with Party B’s employment as
herein provided.
(二)对受聘方的工作进行指导、检查和评估。
2. Party A shall conduct regular supervision, inspection and review of Party B’s
working performance.
(三)向受聘方提供必要的工作和生活条件。
3. Party A shall provide Party B with the necessary working and living conditions.
(四)按时支付受聘方的报酬。
4. Party A shall pay Party B's salary as scheduled.
六、受聘方的义务:
VI. Party B's Obligations:
(一)遵守中国的法律、法规,不干预中国的内部事务。
1. Party B shall abide by laws and regulations of the People's Republic of China and
shall not interfere in China's internal affairs.
(二)遵守聘方的工作制度和有关外国专家的管理规定,接受聘方的工作安排、
业务指导、检查和评估。未经聘方同意,不得兼职。
2. Party B shall comply with Party A’s working regulations and other relevant
administrative stipulations concerned with Party B’s employment, and shall be subject
to Party A's arrangements, supervision, inspection and review of his/her working

performance. Without Party A's consent, Party B shall not conduct any part-time job
assigned by any other party.
(三)按期完成工作任务,保证工作质量。尊重师生,不得私自组织师生参加非
教育教学类活动。
3. Party B shall fulfill the tasks assigned to him/her with high standards within the
prescribed time frame. Party B shall respect teachers and students, and shall not
privately organize teachers and students to participate in the activities which are not
related to education and teaching.
(四)尊重中国宗教政策。不从事与身份不符的活动。
4. Party B shall respect China's religion policies, and shall not conduct any religious
activities incompatible with his/her status as a foreign expert.
(五)尊重中国人民的道德规范和风俗习惯。
5. Party B shall respect Chinese people's ethics and customs.
(六)乙方需遵守聘用方制定的外教行为规范(见附件2)。
6. Party B shall conform to the Code of Conduct for Foreign Teachers which is made
by Party A. (See Appendix 2)
七、合同的变更、解除和终止:
VII. Revision, Cancellation and Termination of the Contract:
双方应信守合同,未经双方一致同意,任何一方不得擅自变更、解除和终止合同。
Both Parties shall abide by the contract and shall refrain from revising, canceling, or
terminating the contract without mutual consent.
(一)合同的变更。
经当事人双方协商同意后,可以变更。在未达成一致意见前,仍应当严格履行合
同。
1. Revision of the contract.
This contract can be revised with mutual consent. Before both parties have reached an
agreement, the contract shall be strictly observed.
(二)合同的解除。
经当事人双方协商同意后,可以解除合同。在未达成一致意见前,仍应当严格履
行合同。
2. Rescission of the contract.
This contract can be rescinded with mutual consent. Before both parties have reached
an agreement, the contract shall be strictly observed.
(1). 聘方在下述条件下,有权以书面形式通知受聘方解除合同:
(1). Under the following conditions, Party A shall have the right to inform Party B in
writing of the rescission of this contract:

A.受聘方不履行合同或者履行合同义务不符合约定条件,经聘方指出后,仍不
改正的;
A. Party B fails to fulfill his/her obligations as the contract herein stipulated, and
fails to amend his/her actions after Party A has pointed it out;
B.根据医生诊断,受聘方在病假连续30 天后不能恢复正常工作的。
B.On the basis of the doctor’s diagnosis, Party B fails to resume normal work after
a sick leave for a period of successive 30 days.
C.在试用期间被证明不符合录用条件的;
C.Proven to not fulfill the qualifications for recruitment during the probation
period;
D.严重违反劳动纪律或者用人单位规章制度的;
D.To seriously violate labor disciplines or the rules and regulations of the
employing units;
E.严重失职,营私舞弊,对用人单位利益造成重大损害的
E.To cause great losses to the employer due to serious dereliction of duty or
engagement in malpractice for selfish ends;
F.被依法追究刑事责任的。
F.To be investigated for any criminal responsibilities in accordance with the law.
(2).受聘方在下述情况下,有权以书面形式通知聘方解除合同:

C.当事人一方要求解除合同,应提前30 天以书面形式向另一方提出,30 天以
后方可解除合同。
C.In case either party asks to terminate this contract, it shall give a 30 day notice to
the other party in writing, and the contract shall only be terminated after 30 days.
D.双方协商一致,可以解除合同。
D.This contract can be terminated upon mutual agreement by both parties.

(三) 合同终止。
3. Termination of the contract.
(1)合同期满该合同即告终止。
(1) This contract shall be terminated once it expires.
(2)经当事人双方协商同意后,也可以终止该合同。在未达成一致意见前,仍
应当严格履行合同。
(2) This contract may be terminated with the mutual consent of both parties, and it
shall be strictly observed until both parties reach an agreement otherwise.
八、违约金:
VIII. Breach Penalty
1. 当事人一方不履行合同或者未完全履行合同所规定的义务,即为违反合同,
应当向另一方支付10000 元人民币的违约金。
1. When either party fails to fulfill any part or all of the obligations as stipulated in
this contract, that is, in the event of a breach in the contract, the said party shall pay a
breach penalty of 10,000 CNY.
2. 受聘方因不可抗力事件要求解除合同,需出具有关机构证明。经聘方同意解
除合同后,受聘方离华的费用自理;受聘方若无故解除合同,除离华费用自理外,
还应当向聘方支付违约金。
2. When Party B claims to discharge this contract due to force majeure, it shall
provide certifying documents issued by competent authorities. After the contract is
discharged with Party A's consent, Party B shall bear the traveling expenses thus
incurred. If Party B fails to provide any valid reason to discharge this contract, Party
B shall bear the traveling expenses thus incurred and pay the breach penalty to Party
A as stipulated in this contract.
When Party A claims to cancel this contract due to force majeure, and the contract is
thus canceled with Party B consent, it shall bear Party B's traveling expenses thus
incurred. If Party A fails to provide any valid reason to cancel this contract, Party A
shall bear the traveling expenses thus incurred to Party B and pay the breach penalty
to Party B as stipulated in this contract.
九、本合同附件为合同不可分割的组成部分,与合同具有同等法律效力。
IX. The appendix of this contract forms an indispensable part of this contract and
shall have the same legal effect with the text of this contract.
十、本合同自双方签字之日起生效,合同期满即自行失效。
当事人一方要求签订新合同,应当在本合同期满前30 天向另一方以书面形式提
出,经双方协商一致同意后签订新合同。
X. This contract shall take effect upon being signed by both parties and shall be
automatically terminated upon expiration. When either party requires signing a

renewed contract, it shall forward a written request to the other party 30 days prior to
the expiration of this contract, and both parties shall sign the new contract through
consultations and mutual consent.
受聘方合同期满后,在华逗留期间的一切费用自理。
Upon the expiration of this contract, Party B shall bear all the expenses incurred
during his own stay in China.
十一、合同争执解决方式
XI. Settlement to Dispute
当事人双方发生合同争执时,尽可能通过协商或者调解解决。若协商、调解无效,
可向当地人事或劳动仲裁机构申请仲裁。对仲裁结果不服的,可向人民法院提起
诉讼。
Any dispute in connection with this contract shall be first of all settled through
friendly consultation and intermediation. In case no settlement can be reached through
consultations or intermediation, both parties shall submit the said dispute for
arbitration with local personnel authorities or the local labor arbitration system. In
case either party refuses to accept the arbitration award, it may bring an action before
the people's court.
本合同于_______年月日在中国签署,一式两份,每份用中文和英文写
成,自签署之日起生效。

duplicate, each in both Chinese and English versions, and both shall take effect upon

Appendix 1 to the Contract
一、乙方(个人)职责和义务
I. The Duties of Party B ( for each person ) and Relevant Obligations
1. 乙方作为全职英语教学教师,在深圳市宝安区_____________教学。
1. Party B shall teach as full-time English teacher at ____________of Bao’ an District,
Shenzhen.
2. 每周不超过20 个课时,每天工作时间8 小时(包括课时),每周工作五天。
2. No more than 20 class hours per week, 8 work hours per day (includes class hours
and office hours), 5 days per week.
3. 为了提高教学质量,乙方必须接受甲方管理,遵守校方教学管理规定,参加
由英语教研室组织的教学研究会议。
3. Party B shall accept Party A’s guidance in order to improve teaching quality,
observe the school’s teaching management regulations, and attend the teaching
research meetings arranged by the English Department.
二、乙方薪资待遇及其他支出
II. Party B’s Salary, Treatment and other expenses
1. 乙方每月税前工资____10,000_______人民币,其中基本工资____9500_____
元人民币,全勤奖金____500___元人民币(全勤奖金的获得:每月按时上岗,并
无迟到、早退、旷课、请假等,可全额获得)。乙方工资从乙方到岗之日起生效,
至合同失效之日为止。甲方应在每月10 号之前支付乙方上月薪资。不满一个月,
薪资按天计算。日薪按月薪除以21.75 天计算。
1. Party B's monthly salary will be ___10,000___CNY (before tax), of which the base
salary is_____9500___CNY, and a bonus of ____500____CNY per month for full
attendance (Bonus for full attendance can be acquired by arriving to work on time and
by not having any tardiness, leaving work early, truancy, or leave of absence). The
salary will be calculated from when Party B arrives and starts working at the school,
until the last day stated in the contract. Party A shall pay Party B’s salary regularly on
the 10th day of every month under the terms of the contract. If the period is not a
whole month, the salary will be calculated and paid by the working day. The daily
salary is calculated by dividing 21.75(days) from the monthly salary.

(1) 住房:甲方落实用人单位为乙方提供免费住房,包括:空调,热水器,冰箱,
洗衣机,家具,宽带,彩电。

(1) Housing: Part A shall be responsible for requesting the employer to provide Party
B with free apartment including an air conditioner, electric water heater for shower,
fridge, washing machine, basic furniture, internet and a TV.
(2) 医疗服务:甲方为乙方购买重大疾病保险和意外伤害保险。
(2) Party A should purchase critical illness insurance, and accidental insurance for
Party B.
3. 甲方落实用人单位提供乙方以下费用:房租,宽带费,物业费,水电气费及
外教来华后的一次体检及签证办理费用。(其中水电费每月最高限额为300 元)
3. Party A shall be responsible to request the employer to bear the costs of rent,
internet, property fees, water, electricity, gas, one health check and visa fee for Party
B after his/her arrival. (water, electricity and gas will be paid 300 CNY per month at
most)
4. 乙方工作一学年后,甲方应向乙方支付机票补贴税前8000 元人民币。
4. When Party B completes the terms of the one academic year contract, Party A shall
pay a travel allowance to Party B 8000 CNY(before tax)for foreign teachers.
5. 乙方应在甲方规定的时间到达中国深圳,甲方支付乙方的培训费用和培训期
间的食宿费用,但甲方不承担外教到达深圳前的所有交通和食宿费用。
5. Party B shall arrive in Shenzhen, China on the scheduled date and time stated by
Party A. Party A will be responsible for the costs of training, accommodation and
meals during the training period. However, Party A shall not be responsible for any
transportation and/or accommodation fees until Party B arrives in Shenzhen, China.
三、工作时间及假期
III. Working time and Holiday(s)
1. 若需乙方加班,甲方应按国家法律规定向乙方支付加班费。
1. If Party A needs Party B to work overtime, Party A shall pay Party B extra in
accordance with law.
2. 乙方享有元旦、清明、五一劳动节、中秋节、国庆节及中国国家法定假日。
2. Party B shall have the following Chinese holiday(s): New Year's Day,
Tomb-sweeping Day, International Labor Day, Mid-autumn Day and other holiday(s)
enacted by Chinese government.
3. 根据国家宗教习惯,乙方享有圣诞节假日(两天)。
3. Party B shall have a two-day vacation for Christmas holidays, according to the
nationality and religion.
4. 寒假期间,甲方向乙方支付半薪。
4. During the winter holiday, Party A should pay half the salary to Party B.
四、病假与事假
IV. Sick Leave and Private Affair Leave
1. 乙方若申请病假,需出具医院的医疗诊断证明。无证明的按旷工处理。

1. If Party B asks for sick leave, Party B shall provide a medical diagnosis issued by
the appointed foreign-related hospital. Without any type of written notice from the
hospital, official sick leave may not be issued to Party B.
(1)一次请病假不超过三天的(含第三天)不扣工资。
(1) A sick leave not exceeding 3 days will not result in any salary deduction.
(2)一次请病假三天以上的,按照学校的有关规定处理。
(2) A sick leave exceeding over 3 days will be treated according to relevant
provisions of the school.
2. 乙方申请事假应征得甲方同意。事假期间,工资相应扣除。一学年合同期间,
乙方累计个人事假不得超过10 天,单次个人事假不得超过三天。超过规定事假
天数工资双倍扣除。旷工一天或旷课一次者扣除日工资的三倍。情节严重者,指
连续旷工两天(含两天)以上,或连续旷课两次(含两次)以上,或累计旷工三
天(含三天)以上,或累计旷课三次(含三次)以上的情形,但且不仅限于以上
情况,甲方有权终止合同并追究乙方违约责任。
2. Party B must request Party A's consent if it wants to ask for a private affair leave.
Salary will be deducted by the day. During the one contract period (one academic
year), Party B's accumulated private affair leave should not exceed ten days and each
private affair leave should not exceed three days. The exceeded leave will lead to
double salary deduction. If Party B leaves one day or one class time without Party A's
consent, the deducted salary for leave is three times of the daily salary. In case of
serious violations such as but not limited to the following situations: any absences
without consent exceeding the continuous period of two days or more, or
continuously absent for two classes and more, accumulatively exceeding three days
(including the third day), or accumulatively absent three class times and more, Party
A reserves the right to terminate the contract and Party B's violation will be pursued.
3. 凡伴有慢性病经常请假,不能正常参加教学工作的,并造成很坏的影响的可
重新安排工作岗位或劝其离职。
3. If Party B takes excessive leave of absences due to chronic diseases, cannot
participate in the regular teaching workload, and/or creates a negative environment
within the school, Party A retains the rights to rearrange Party B’s working position or
advise his departure.
五、此合同附件的确定和修改必须征得双方同意并书面记录。即口头协议无效。
V. The confirmation and modification of this appendix must be agreed by both sides
and recorded in writing; any oral agreement is not valid.
此合同附件与合同不可拆分,并具有同样效力。
The appendix of this contract is an inseparable part of the contract and has equal
effect.

Contract Appendix 2--Code of Conduct for
Foreign Teachers
合同附件2--外籍教师行为规范
1. Foreign Teachers shall obey China International Teachers' Association (CITA) and
the school's dual management. To hand in the teaching plan on time, and give CITA
some feedback about our teaching requirement and teaching instructions.
外教应遵守CITA 和学校的共同管理。积极配合CITA,及时上交教案,及CITA
要求的教学反馈信息。
2. Foreign teachers are expected to abide by classroom discipline. Pay attention to
your appearance and dress neatly when teaching. Do not wear slippers, vests or
shorts;smoking and eating are not allowed in classrooms.
外教应遵守课堂纪律,注重仪表。不得穿拖鞋、背心或短裤;不得在课堂内吸烟,
进食。
3. Foreign teachers shall conform to “the Professional Ethics of Primary and
Secondary School Teachers” of the People’s Republic of China. Do not engage in
affairs or develop any intimate relationship with students.
遵守中华人民共和国《中小学教师职业道德规范》。不得与学生发生不正当关系。
4. Without permission of the school, foreign teachers are not allowed to obtain
additional teaching employment and/or engage in any business unrelated to their
teaching roles in the appointed school.
未经学校允许,外教不得在外兼职,不得在学校内从事任何与教学无关的事务。
5. Foreign teachers shall obey teaching assignments and class schedules of the school
and shall ensure 8 working hours per day, including office hour (at most 20 class
hours per week, teaching assignments include the ones in the class and outside the
class).
外教应遵守学校的教学任务及课时安排,确保每天工作8 小时(每周最多20 个
课时,教学任务包括课堂及课外)。

6. The accommodation provided by school can only be used as a place of residence
and shall not be used for other purposes. Illegal activities, such as gambling,
pornography, and excessive drinking are strictly prohibited in the apartment. Without
school’s permission, meeting others in the apartment and letting them stay overnight
is not allowed.
学校所提供的住房不得用于住宿之外的其他用途,严禁在住处进行赌博,吸毒,
嫖娼,酗酒等其他非法行为,没有得到学校允许,宿舍不能会客及留宿他人。
7. Do not allow students to visit your apartment and/or stay there overnight. Students
shall visit the foreign teacher’s office after class.
外教禁止带领学生参观住处,不得允许学生在住处留宿。
8. Foreign teachers shall inform the school about your whereabouts when you are out
of town for more than one day (24 hours). Report to school and CITA Shenzhen office
about your traveling information (traveling vehicles, companions, destinations,
duration and emergency contact) before you travel.
外教若外出一天以上(24 小时以上),应告知校方。外教应于出发前告知学校和
CITA 深圳办公室相关外出信息(如所乘交通工具,陪同人员,目的地,停留时
长及紧急联系人)。
9. The school reserves the right to inform relevant government agencies and other
organizations about the foreign teachers who are dismissed and violate these
regulations .
学校有权将被开除和违背管理制度的外教情况告知政府机构及其他组织。
10. Foreign teachers shall inform China International Teachers' Association (CITA)
about their dissatisfaction, and they are not allowed to denigrate or slander CITA’s
reputation in private, as well as individually or as a group hinder any normal teaching
work.
外教若有不满情绪,应及时与CITA 沟通,不得私下诋毁,或中伤CITA 形象,
妨碍正常教学工作。 |
I should have immediately declined the offer, but since I was curious (and naive), I decided to address many of the contract's problems with an email. Recruiter responded and talked to me online again, saying that their contracts can't be modified because they need a lawyer to do it along with some other random nonsense. To somehow relieve me of my worries, recruiter had me speak with the "leader" so I can ask him questions and provide any concerns. Well... it turns out that this conversation I had with him was an incredibly short interview in which he asked me questions about my qualifications, and then immediately ended the conversation; I didn't even have a chance to ask any questions in return.
I even managed to track down one teacher who worked with CITA; he said he enjoyed the school he was contracted to and was always paid on time, but he mentioned that CITA had problems with processing visas. Oh... he also arrived on a tourist visa and said this: "Most [CITA] people arrive on a tourist or business visa and then they start the process for the Z visa after you are placed in your school."
Considering what I experienced, I highly advise people to stay clear of CITA. |

The British interviewer would not give me the privilege of speaking or e-mailing other foreigners, past or present that worked for CITA. He would not allow me to ask questions about the job conditions either. It is as clear as day one needs a Z Visa or Business Visa to work in China, legally, so that is the least of my concerns. I would make sure I get a visa. Yet CITA continue to advertise, they are an audacious lot!
However, one thing I have begun to notice about Chinese employers is, when asked If one could speak with past employees they tend to dissemble, or talk equivocally. I have also found many recruiters to be incompetent or untrustworthy. I would not use them if there were another option. I have found South Korean recruiters to be more transparent than their Chinese cousins.
Seriously, we have all been through some B.S when working overseas as a teacher, or most of us have. It is an unpleasant and mentally draining experience I would like to avoid completely, if I can secure a job in China. |

10k is low in shenzhen but your accommodation is free. if you work at other places you'll make more, but you'll be expected to pay your own rent and stuff. and down there you'll have at least a few thousand set aside for rent every month, leaving you with 10k to spend on other things if you're lucky. this person sounds hysterical anyway. |
