WRONG WRONG WRONG.
Here's the loop hole: Apply for a job with a reputable school while out-of-country in your home country. Get hired. Pass the medical test(s). Jump through the usual hoops of getting a Z visa. Arrive, then get your residence permit. Then behave yourself.
Simple. |
Those are facts, yes. But the actual "loophole" is that whereas laws are set in stone in some countries, in China they are set in clay. Therefore, reality often differs strongly from official statements or documents. Scenario: a school in a less desirable region needs to replace a teacher quickly and has an applicant over 60 or lacking a degree. So the school exchanges a favor or greases a palm, and voila! Hard rules become soft ones, and the powers that be look the other way and issue a Z visa. I don't know how anyone who has lived/worked in China for even a few months cannot digest this. |

Fair enough ... it is up to the individual how they respond and when they think is a prudent time to carry .... during times of the mobile and hostile, I carry ... yesterday .. at a Korean eatery with a friend and the ensuing ride home, I just carried a cell phone.... |

Two points about this whether it is true or not.
Firstly - If police in the UK went to say a Chinese restaurant at Chinese New Years and demanded to see the passports of every 'Asian looking person' there would be absolute bedlum and China would be complaining and allsorts.
Secondly, with regard to the law here.
An old acquaintance[Chinese] opened a tutoring school basically offering 1 to 1 classes arranged online and through wechat[no actual school]. He used my picture on sites such as 68.com and through advertising without me knowing, and even wrote my name.
I was called and asked to go to the cop shop, so I went. The policeman said it was to discuss extending my residence permit to a long term one. No problem there I thought.
I get in and he plods down two pieces of paper with my name and photo on and details of the school in Chinese. At this point I start recording because I think something is shady. He asks if that's my name, it is I reply, he asks if it's my picture, it is I say. He says that I must have been working illegally for this guy, and he needs 2000 RMB. I say I didn't work there and that I haven't seen the guy for over 6 months.
At this point he says 'ok, ok, look, you tell me what you know about this tutor place and I'll let you go without a fine.' I tell him I didn't work there so of course I wouldn't get a fine anyway. Being polite I just said it was a Chinese and that he ran a 1 on 1 tutoring service but that I had no idea about teachers or numbers or price or anything.
He thanks me and shakes my hand. A week later my girlfriend get's a call and the police guy says that I must pay 2000 into the bank account of the government as a fine.
I play her the recording and she says we don't need to pay.
At this point my friends wife who is well connected gets involved and says that it's outrageous and she will speak to the chief of police on my behalf in the province.
Turns out that the guy who initially spoke to me had a 'payment' to make at Spring Festival and was behind, and that my picture being used was proof I worked there.
I turn up at the office and he says 'oh good, you decided to pay.' I said no, under Chinese law I'm entitled to appeal the decision because it's unfair and unlawful.
I didn't care so much about 2000 RMB but it bothered me it was plain extortion.
Anyway, short end of the story, the lower ranked policeman called my friends wife and said if I don't pay he won't process the appeal and that they will cancel my visa the week after.
So yes, even if you are legal and didn't do anything wrong, the police can still do what they like because they hold that threat of cancelling visas and cutting you short.
Even if you get the long term 10 year visa they can still cut it and cancel it. In the UK if a Chinese gets a right of abode and the police decide to deport them, they can appeal to a court, and guess what? They aren't deported whilst awaiting for that appeal, if that appeal fails they can appeal to the European Courts etc.
In China before you can even appeal to a manager of a basic cop they can just cancel your visa. |

Being extorted is butthurt?
I enjoyed my time in China, some people are great, but you're delusional if you think there isn't racism, cheating, nationalism above and beyond anything I've even seen in other parts of Asia.
I did make a killing in money, and saved alot for travelling, although the pollution trashed my eyes, so you win some you lose some.
There's no point in posting 'I had a good day, I hurt my lungs with the pollution but no one was racist to me!' everyday, it's better to expect people to not have a bad experience everyday and then post about the bad things that do happen. |
