Hi all - completely new to this been offered the following.
Could you please give me opinions on whether the contract looks ok & could I find an apartment in Shenzhen for 2500 if the school doesnt provide it.

聘用意向书
Employment Intention Letter
甲方(用人单位):中国(深圳)国际人才培训中心
Party A (Employer): China (Shenzhen) International Personnel Training Centre
乙方(员工): 护照号:
Party B (Employee): Sharon XXXXXX Passport Number: XXXXXXXX
甲方有意聘用乙方为外籍教师,乙方有意受聘并接受甲方所提供的基本待遇。双方本着平等自愿,协商一致的
原则,达成以下本意向书:
Party A intends to employ Party B as a foreign teacher and Party B is willing to be employed and accept basic
compensation provided by Party A. Party A and Party B come to the following employment agreement on the basis of
equality, free will and mutual consent:
一、工作内容:甲方拟聘用乙方从事教师 工作。
Position: Party A will employ Party B in the position of Teacher .
二、拟聘用期限:从到 2016 年 2 月 20 日起至 2016 年 7 月 15 日止。
The prospective employment term shall commence from February 20th ,2015 and end on July 15th
, 2016.
三、工资:乙方每月工资为 9000 元(税前),正式起薪日为双方正式合同签署日。
Remuneration: Party B shall be entitled to RMB 9000 per month (before tax). The salary starts from the day when
both sides sign the formal contract.
四、甲方提供住宿。乙方居住在教学点所提供的住房内,若教学点无法提供住房,甲方将提供 2500 元/月的住房补
贴给乙方用于租房。
Party A provides accommodation. Party B will be living in the housing provided by school. If school doesn’t provide
housing, Party A will provide 2500RMB/month for Party B to rent apartment.
五、保险:乙方持工作签证并与甲方签署正式聘用合同后,甲方为乙方购买人身意外和公共交通意外保险。乙方获
得深圳公安机关颁发的《居留许可证》后的下一个月起,甲方为乙方购买社会保险。社会保险卡将由政府职能
部门于乙方取得《居留许可证》后 50 个工作日左右发放给乙方(节假日顺延)并开始持卡享受与中国国民一
样的社会保险待遇。乙方如需就医,须在社会保险定点医院就医并按社会保险规定承担相应比例的费用,在非
定点医院就医费用自理;受聘方的挂号、就医交通、镶牙、整容、保健按摩、配眼镜、住院用餐和服用非医疗
性的滋补药品以及医生出诊等费用自理。
Insurance: Party A will buy personal accident and public transportation risks insurance for Party B after both
arriving in China on a work Z visa and signing a formal employment contract. Party A will buy social insurance
for Party B after getting the Resident Permit from the Public Security Bureau. Under this insurance Party B will
be entitled to the same social insurance treatment as domestic local citizens. A social insurance card will be
issued by the Social Insurance Bureau around 50 work days after receiving the Resident Permit (this will be
delayed if there is a public holiday). If Party B needs to see a doctor, he/she has to visit doctors at designated
hospitals covered by the social medical insurance or commercial insurance and undertake the relevant
proportion of expenses according to the policy. Cost for outpatient registration, transportation, dental care,
face-lifting, therapeutic massage, filling a prescription for glasses, hospital food and taking nutritious food as
well as appointing doctors will be undertaken by Party B. If Party B sees a doctor at a hospital not covered by the
social insurance or commercial insurance, he/she needs to cover all the expenses.
其他条款以报到后签订的正式合同为准。
For other conditions of employment please refer to the formal contact which will be signed after arrival.
六、注意事项:
Notice:
1. 乙方需在收到甲方聘用意向书后 5 天内签署并发送回甲方,否则当自动放弃处理。乙方签署聘用意向书后应该
立即准备以下文件给甲方用于办理签证相关文件:
Party B shall sign this document within 5 days or will be considered as turning down the offer. Party B shall provide
following documents after signing the Employment Intention Letter:
1) 护照复印件及过往所有的中国签证复印件,确保护照在合同期内有效并有 3 张以上空白签证页
Scanned copy of the passport and all Chinese visas. Make sure the passport is valid throughout the contract term and
with more than 3 blank visa pages.
2) 最高学历证书扫描件
Scanned copy of their highest university diploma
3) 教师资格证书扫描件
Scanned copy of their teaching certificate
4) 健康体检报告扫描件,半年之内有效
Scanned copy of their health check, within 6 months
5) 无犯罪记录,半年之内有效
Scanned copy of their statement of no criminal record,within 6 months
6) 推荐信
Scanned copy of recommendation letters
乙方需在签署意向书后2周内提供甲方所需的办证文件,乙方如因提供的资料不齐或延误,造成无法如期办证,
责任自负。
All Documents requested must be provided by Party B within two weeks. It will be Party B’s responsibility if
documents submitted after this deadline result in the inability of Party A to process Party B’s visa.
2. 待甲方收集齐乙方提供的所需文件后,办证时间需要四周左右。相关文件办理完毕后甲方会将文件以快递形式
寄送给乙方,请乙方务必及时到国籍国的中国使领馆办理工作签证并持工作签证入境。
It will take about four weeks to process the visa application in China and can only be started after Party A has received
all necessary documents mentioned above from Party B. Once the required visa processing documents have been
compiled they will then be sent by express mail directly to Party B. Upon receiving this necessary paperwork, Party B
shall go to Chinese Embassy or Consulate to apply for work visa (Z visa) and shall only enter China on this visa which is
needed for legal employment on mainland China.
乙方需自行承担来华工作的签证、机票等一切费用。乙方在甲方每工作满一学期后可凭机票原件报销一张不超
过人民币 5000 元的机票费用,或领取人民币 5000 元的机票补助(税前)。合同期内乙方报销的机票费用及领取
的机票补助总额不可超过 10000 元人民币。
Party B will cover all the costs associated with coming to live and work in China, including but not limited to visa and
flight cost. Party B is entitled to reimburse one flight ticket up to RMB5000 or receive a flight allowance of RMB5000
(before tax) per full semester worked. Flight reimbursement and allowance shall not exceed RMB10,000 within one
contract term.
3. 乙方来中国时,请确保带上最高学历证书原件、教师资格证原件以及无犯罪记录原件以通过政府职能部门的审
核。若无法提供原件或遭政府职能部门拒绝,甲方将无法为乙方进行居留许可申请并意味着聘用关系的提前终
止。同时,乙方入境后需进行健康检查和公安局面谈,如因身体健康原因或无法通过公安局面试而无法办理居
留许可的,甲方唯有解除合约。因本条款上述原因导致终止或解除聘用关系的,甲方不负任何责任,并不作任
何补偿。
While coming to China to commence employment, Party B must bring their original highest university diploma,
original teaching certificate and original police background check as requested by the Foreign Experts Bureau. Failure
to bring these original documents or rejection by Government Bureaus for any reason will prevent Party A from being
able to apply for a residence permit for Party B and will result in early termination of the employment relationship.
Party B will need to take a health check and a police interview after entering China, if any factors to the fault of Party B
such as health issues or failure of the Public Security Bureau interview for resident permit, Party A has no choice but to
terminate the contract. If any of the above mentioned items lead to the termination of the employment relationship
Party A bears no responsibility and will not provide any compensation.
该协议经双方签署后开始生效,有效期最长为 1 个月,但到双方签署正式聘用合同时终止。
This letter will be valid for 1 month when endorsed by both sides, and will be terminated after the formal employment
contract is signed.

This is a draft of the contract I will get
Primary School ESL Job Description:
1. Location: Futian or Luohu district, Shenzhen, China.
2. Contract term: Feb. 20, 2016 - July 15th, 2016, renewable.
3. Students Age: 6 -12 years old
4. Working Days: Mondays to Fridays. two days off on weekends.
5. Working hours: 8:00am-12:00pm, 2:00pm -5:30pm.including 12-18 teaching hours per week.
Remuneration and Benefits:
1. Salary:RMB9,000 monthly.
2. Accommodation: three options:
a) school provides
b) RMB2500 monthly apartment rent allowance.
c) a hotel room
3. Vacation: one month fully paid winter vacation.
4. Holidays: Full paid 11 days Chinese public holidays.
5. Airfare allowance: RMB5,000 each semester.
6. Insurance: Medical and Accident Insurance provided.
7. Tour in China: Twice per year, one trip arranged each semester by employer.
8. Working permit and invitation: yes.

It seems to be written by someone with half a brain and a native speaker. You have to give it that.
This would concern me a bit...
“Party B will cover all the costs associated with coming to live and work in China, including but not limited to visa and flight cost.”
I would make sure that the visa costs at their end (which are quite substantial now) are not to be paid back to them in any way by you.
This would scare the hell out of me.

Will that include?
“You must dress up like a clown on weekends and dance around the streets of Shenzhen merrily handing out school brochures. Failure you to do so will mark you as a troublemaker and result in a fine of 9000RMB a month.”
A point to note.
“This letter will be valid for 1 month when endorsed by both sides, and will be terminated after the formal employment
contract is signed. “
Be aware that if you sign this, they will start the visa process and the new national system (if Shenzhen is now tied in to it) will prevent another employer from starting a similar visa process. This protects the employer from having no-shows after some considerable effort and expense, but it does lock you in to that employer if you playing the field so to say.
I have to say, 9000 a month gross in Shenzhen for having to spend your entire day basically at the school? Usually those full timers willing to endure little emperors and empresses do better than that, especially in a tier one city.
No personal experience on Shenzhen costs besides hotel rooms. Yet regardless of city, you will need to dish out a lot of money upfront to secure an apartment.
Some teachers do prefer the benefits of choosing their own apartments. Personally, I would be be hesitant to do it as the upfront costs rather binds one to the city, which is a bad thing if your school turns out to be unbearable.
At the least, I think no formal contract shown beforehand, no go.
