|
|
I have been informed by the visa office that I don't need to send in any criminal record check for a Z visa. I think I may have a conviction for assault of a police officer on mine and it will stay on for another 2 or 3 years before being spent. Has any UK teacher needed to show the school a criminal record check? If so was it a basic disclosure or an enhanced one? |

From what people have been saying about CBCs being required, it is not when actually applying for the Z-visa itself. It is the step before when it is required. The step before is the school obtaining the official invitation letter for you so you can get the Z-visa.
Sorry if this is a little personal, but how do you think you may have a conviction? Sounds awkward to me. The school usually would only request one if they needed it to get something from the government. |

I think I may have a record because I was in court a few years ago for pushing a police officer at a train station. |

But you don't know if you were convicted? Do you think you might have spent a night in jail or paid a fine? |

I was convicted yes and now I am worried because I am trying to get a job in China. The policeman pushed me first and I instinctively just put my hands out and pushed him back. I think I had to pay a fine. |

I am from UK and I had to get one in 2014, despite already having been in China for 7 years.
The rules were updated and most if not all provinces now require one for the resident permit which is the step after the initial z visa.
It may well be that the province you intend to work in has not implemented this yet but I would make double sure with them about this, however don't be at all surprised if after you arrive in China you miraculously have to produce one.
As for 'thinking' you may have a conviction. Either you have or you haven't, if you were convicted of anything it will show on an 'enhanced' disclosure but will not show on the 'basic' check after the spent period has expired.
If it is a concern to you, I would do two things, firstly make double sure that it is not required (either now or later) and apply for your record anyway to make sure. You can walk into any police station with your passport or driving licence and apply, pay the fee and it will be sent to you about ten days later. |

Just curious, how far back did the record check go? |

Should you have any convictions, it lists any convictions dating back to 13 years old that are not spent under the rehabilitation of offenders act which covers the UK.
If they are spent they will not show up on the basic disclosure but will on the enhanced one which only certain Government departments usually require. |

I was thinking about how far back the Chinese government would expect it to go. Thanks for the answer.
I have no record beyond when I was 12, and all of that is sealed. I did not request for it to be sealed, but I know it was. I had a CBC for the Navy, and they were ready to let me free on the nukes. |

hz Do you work with children in china? The post I went for was working with adults and does not stipulate that I would need a CRC. Perhaps only a basic disclosure is required for adult jobs. Just wondering if they asked you for a basic or enhanced disclosure. |

I think the majority of people on here are seeking teaching jobs and therefore work with children.
I was not specifically asked for an enhanced check but I got one anyway just to be on the safe side.
Back home as you know if you are working with children or vulnerable persons you need the enhanced disclosure, the new hires we had this year from UK had the basic disclosure and it was accepted without issues.
The point is that whilst now you may not need one where you are working, the rules may change later and then you find yourself having to obtain one anyway. If I were you I would just get one. A background check is now required in the vast majority of provinces in China. Multiple threads have discussed this. |

If I get a CRC it will probably show up those offences I mentioned so not too sure if the school will be OK with it. I didn't get the job anyway in the end so I am still looking for 16000RMB a month job which is what this adult language school were offering. |

I thought only companies or employers could request these checks anyway?
I think that's definitely the case with the enhanced check. I don't think you can just apply for an enhanced check yourself. |

Are you kidding me? Violence against a police officer? If there is so much as a trace of that on your record forget teaching in any province that requires cbc. |

The government requirement is for a clean record. Mass murder, assaulting a police officer, streaking, eating a Mute Swan and so on are all seen as equally disqualifying offenses. I just can't imagine a Chinese bureaucrat willing to put his pi gu on the line by showing independent judgment. |
