The FBI has jurisdiction (supposedly) over the U.S.. "Federal" refers to the United States central government. Citizens of their own country need to apply to their own jurisdiction.
For those who are still in the U.S. and are in a quandry, check out this site:

Check out the different sections to get an idea of how helpful the site is. |

Which province will this be for and what kind of police background check? |

Jiangsu. The employer said a 'local' police check would do BUT it has to have a signature on it (I'm not sure exactly what signature as what's stopping me from printing out a fake one, signing it myself with 'officer Bob'...
If I'm not in the UK (which I'm not), the employer said an ARCO police check. Through emails with the university it seems a DBS will also do. However, as the ARCO is the one recommended on the documents and they reimburse for the police check, I'm going with the ARCO. |

Really? All the feedback over the last couple years has been for an FBI check? Can you expend on this? Is this very recent? Did you encounter this in a particular province? It is possible some jurisdiction have lightened up on this requirement, but the FBI has seemed the trend in more jurisdictions.
You are screwed if it is FBI as the DUI will show up. It must come back SPOTLESS. If I were the poster, I would ask the schools for the type required and see if you can get by with a state. Then I would do online research to try to verify that the school's answer is accurate before proceeding.
I should add that you are focusing on the Eastern provinces which are pretty stringent. Shanghai has liberalized, and you may want to focus on other regions of China. |
Can I accurately infer from this that a dismissed charge would still be a problem? |
If it shows up on the check, then yes. Get it expunged . |
If I get it expunged, it will still show up on my background check. |
Could be state specific. I got an assault charge expunged that was on it. A friend who just passed the bar helped me out. Requested another check the next day. |

It is definitely the ridiculous state I am a resident of. I'm having it expunged but the arrest record stays.
Fortunately, a local police check is easy and free. |

Yup. When I arrived in China from Korea, a local Korean BC sufficed. Eventually, it won't. But I assume if you continue to renew your Residence permit, it won't be a problem. |

Just to clarify, I was referring to a local check in the States. But I could also get one from my current country of residence. |
