Just curious: is a Japanese company legally required to pay for all unused holidays by the end of a contract? In other words, is it normal procedure to reimburse the employee (either by just adding 10 days pay to the final paycheck, or perhaps adding on another pay period after the contract is expired etc.). Or is it just a "use-it-or-lose-it" kind of thing?
For example, if it is written in the employee`s contract that he/she is entitled to 10 days paid vacation (after a 6 month period), but that person is for whatever reason unable, or perhaps even unwilling (ie. too strapped for cash) to take these days off before the end of the contract, does he/she simply lose these days? What is the (labour standards) law in Japan for this kind of situation?
I am just wondering this, because I know a few instances of busy (namely Japanese) people simply forfeiting their vacations (especially part-timers) because they were too busy to take time off, and couldn`t get their shifts covered etc. I always understood these days off to be required by Japanese law, and not merely "optional" as such. But actually I don`t really know. What is the regular and/or proper procedure here? Thanks in advance for any info! |

Generally the days don't roll over, and you don't get extra money for not taking them. A good company will require you to take the vacation days. My wife's temp staffing company has a two year roll over, but I find her company a heck of a lot more enlightened than the teaching industry. |

Yeah, that`s kind of what I figured too...
But does anybody have a link to a labor law page that would have the official laws concerning paid vacation clearly laid out in text? Just being "entitled" (as per the contract) to paid vacation seems so ambiguous. I`m curious to know what the law is exactly, whether it`s typically followed or not.
As for ever taking a company to court over, I doubt it could ever be worth the trouble, but it`s good to know the law anyway.
BTW, what if a company had, say, only one employee for a given job and it was impossible for him/her to ever get any time off covered (hence no days off ever)? What are the rules for that? I`d be willing to bet it happens here. |
