I was just checking my contract and came across few things I never thought about.

Although I have signed a contract till Aug 20th, 2006 I would be getting holidays from July,2006 to
Aug,2006 which are paid. I would be leaving to my country next year by July, 2006. I have already decided that I would be able to work for 1 year ONLY. I am not planning to come back.
I really don�t think it would be of any use to keep my money till ending of the contract and tell me to come back to China. If I don�t have any pending work left and I am just going to leave country can they tell me to come back to get my salary or airfare.
They would have to pay me 1 month and 20 days salary + airfare allowance 4000. I can understand probably they can�t cough up all that money in July,2006.
My question is whether I should be paid before or after holidays if I am not going to come back.What have been your experiences?
Although some of the last year teachers have returned to my school to get the airfare allowance.School hasn't paid them.They weren�t working on Z visa they are reluctant to go to FAO. I wouldn�t trust my school to keep my money till end of August and pay me later.
If you don't understand then I can explain more later. |

All the information you want should be written into your contract. For example my payday is on the last working day of each month. If I finish teaching on the 10th I get paid on the 10th. If it's not there then I recomend you write it into the contract yourself and send it back to the school before signing anything.
If you do not clear this up with the school before taking up the job, then the cjances are they will pay you at the latest time convenient to them.
On another note, I would not be telling the school that I would be leaving and under no cicumstances be coming back. If the school is not as honest as you hope they would use this against you by holding the money knowing full well that you must leave and there is nothing you can do about it. |

My experience is that they tend to take a while to get it organized. Last year I asked for them to give me the money in mid-December and didn't receive it until the end of January, a few days before I had to leave. It is December again now and I just know it is going to happen again.
Make sure that they know exactly what day you will be leaving. Not just China itself, but the time you are leaving the school. I'm sure they will get it to you pretty much on that day, if they are well organized. |

I have already signed the contract and have been working from 3 months now and I just forgot to add that they should pay me 2 months salary and airfare all at the same time.
Can I tell them to send money to my bank account but who would guarantee that I would receive it.
They aren't well organized and I just realized that they are in financial crisis and so instead of 3-4 foreigners they have only one foreigner and that's ME. They are paying me every month but sometimes not on time. |

You signed for a period of 6 months and 5 days; I guess your duties will be seen as discharged on the 15th of July and you can stay the reaminder free of charge in your flat. That ought to be enough time to settle your financial situation.
I wouldn't go farther in my advice because too much is unclear.
You mentioned other FTs that got shortchanged; apparently they were working in China illegally. If that is your case too don't expect any legal protection!
The airfare is not normally available before your term is completed. You stand to be paid it in July. If you wanted it earlier you should have negotiated a prorated solution. Don't change conditions mid-stream - or you are likely to rock the boat! |

Roger : Thanks ! for your reply but I guess you missed dates. Kindly re-read all the dates.I mentioned in my previous posts that I have signed almost for 1 year and have worked for 3 months now.
Starting from September 15th , 2005 through August 20th ,2006
I have got Residence Permit and I am not working illegally. I have got the sticker in Passport and Foreign Expert Certificate. I have never worked in my 2 and half months on other than Z visa.
If at all I would be seeking any legal protection then I am trying to know what would be realistic solution or final verdict. |
