I'm lookin for schools in Shanghai for this coming fall (06). Does anyone have any info on a school called Shanghai Industry and Commercial Foreign Language College, or SICFL. I've done quite a bit of research on it, but came up empty handed. Any help is greatly appreciated.

This contract condition is unlimited.
I understand that English Corner and 'office hours' are expected and I am happy to agree to specified hours for these events (i.e. English Corner once per week, office hours of 1 hour, twice per week) but I can't agree to the above contract condition.

We have 9 foreign teacher here, and we will recruit 5 foreign teachers for the next semester,We have recruited 3 new foreigners now. We have the same contract with all the foreigners. And all the rules and payments are admired and authorized by the state bureau of foreign experts. So sorry that we can not change the extra courses payment rules.
We can accept your advice for the second part:
Party B shall take part in activities organized by Party A if asked to consisting of English Corner once per week and office hours of 1 hour, twice per week. Other activities advised by Party A will paid for and Party B can choose to accept it or not.

EMPLOYMENT CONTRACT
FOR FOREIGN TEACHERS
I. Party A (the employer): Shanghai I&C Foreign Languages College
Party B (the employee): Mr. / Ms. Of (nationality).
This employment contract is agreed upon by the above mentioned parties based on the principles of friendly cooperation and mutual respect. The parties pledge to fulfill the duties according to the terms in this agreement.
II. The contract period: from to .
III. Detailed job requirements and benefits are listed in the supplementary agreement.
IV. Party A�s obligations:
1. Introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government,Party A�s rules and regulations and other administration requirements of foreign teachers.
2. Provide guidance, supervision and evaluation of Party B�s work.
3. Provide necessary working and living conditions for Party B.
4. Pay salary and other benefits on time.
V. Party B�s obligations:
1. Observe and obey the laws, decrees and relevant regulations enacted by the Chinese government and not interfere with China�s internal affairs.
2. Observe and obey Party A�s rules and regulations and other administration requirements of foreign teachers. Accept Party A�s work assignments, guidance, supervision and evaluation. Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A without Party A�s consent.
3. Complete the required tasks on schedule and with satisfactory quality.
4. Respect China�s religion policies. Respect Chinese moral standards and customs.
VI. Revision, Cancellation and Termination of the Contract:
1. Both parties should abide by the contract. Without mutual consent, neither party should revise, cancel, or terminate the contract.
2. The contract can be revised, canceled, or terminated with mutual consent. the contract should be strictly followed before the mutual consent is reached.
3. Party A has the right to terminate the contract with a written notice to Party B under the following conditions:
(1) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to improve after Party A�s clear request.
(2) Due to medical or health conditions, Party B can not resume normal work after 30 days� of sick leave.
4. Party B has the right to terminate the contract with a written notice to Party A under the following conditions:
(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2) Party A has not paid Party B the salary and/or other benefits as scheduled in the contract.
VIII. Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, it must pay a breach penalty of US$ 500 to 2,000(or the equivalence in RMB)to the other party.
If party A requests to cancel or to terminate the contract on the basis of force majeure, with the consent of Party B, it should bear the cost of the airfare for Party B to leave China. If Party A cancels or terminates the contract without valid reason, it should bear the cost of the airfare for Party B to leave China, plus the breach penalty.
If Party B requests to cancel or to terminate the contract on the basis of force majeure, it should provide valid proof by authorized institutions to obtain Party A�s consent. Party B then should bear all return expenses; if Party B cancels or terminates the contract without valid reason, it should bear all return expenses; It should also pay Party A the breach penalty.
IX. The Supplementary Agreement in the appendix of this contract is an inseparable part of the contract and has equal legal effect.
X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties is interested in renewing contract, it should propose to the other party 90 days prior the expiration of the contract.
Party B shall bear all expenses incurred if staying on after the
contract expires.
XI. Arbitration
In case of dispute concerning the contract, the two parties shall try to solve it through negotiation and cooperation. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.
This Contract is signed in shanghai, in duplicate, on this day of , , in both Chinese and English languages. Both texts have equal legal effects.

Appendix
Supplementary Agreement
I. Party A �s Obligations:
1. Party A shall provide Party B with accommodation on campus or accommodation allowance (see Party B�s Obligations)
2. On 18th of each month, Party A shall pay Party B a monthly salary of RMB 4500RMB . Party B shall bear the personal taxes on salary, which will be deducted from the salary by Party A.
3. Party A shall pay Party B RMB200 per month for food supplement. Of which, RMB100 will be credited to the food card and RMB100 will be paid together with the monthly salary. The taxes on food supplement shall be borne by Party A.
4. Party A shall pay Party B a total of RMB2,200 in two settlements of RMB1,100 (once in October of 200 5 , and once in May of 2006 ) as travel allowance. The taxes on travel allowance shall be borne by Party A.
5. Party A shall reimburse to Party B the round trip economic class air ticket between China and as it actually happened. The maximum amount of ticket reimbursement should not exceed RMB and Party B is responsible for providing the necessary proof of the trip. The reimbursement shall be done at the end of the contract period. Taxes on the airfare shall be borne by Party A.
6. Party A shall help Party B to obtain the resident/work permit and other relevant documents, Party A shall bear the expenses thus incurred.
7. Party A shall treat Party B as the same as domestic employees in terms of holiday gifts.
8. Party A shall purchase an insurance of around RMB1000 for Party B with coverage of accidents and medical expenses. The taxes on insurance shall be borne by Party A.
II. Party B �s Obligations
1. Party B choice of accommodation arrangement is:

A. Party A shall provide Party B with accommodation on campus. The arrangement is valid for one semester. Party B can only change the choice at the end of the semester. Party A will purchase RMB200 worth of water and electricity to start with. Any excess water and electricity charges shall be the responsibility of Party B.
B. If Party B chooses to live off campus, Party A shall provide Party B RMB1,500 monthly as accommodation allowance, which shall be paid every two months. Party B should provide Party A with the original rental contract. The taxes on accommodation allowance shall be borne by Party A.
2. Party B�s regular teaching load shall be 14 periods per week. Extra teaching shall be paid at a rate of RMB50 per period. The taxes on income from extra teaching shall be borne by Party B. It will be deducted at the time of payment by Party A.
3. Party B shall take part in activities organized by Party A if asked to.
4. Party B shall observe and obey the rules and regulations of Party A. Party B shall follow the procedures as required by Party A. In case of foreseen absence, Party B shall obtain the approval of the Department Head, make arrangement for making up classes. Un-made up classes shall be charged at the rate of RMB60 per class, and the amount shall be deducted from Party B �s salary. Missed classes without advanced approval shall be charged at the rate of RMB120 per class, and the amount shall be deducted from Party B�s salary.

Hello,
This is the place I work at. It's a college, not a university, but the students are ok since most of them are English majors. One thing you need to keep in mind is that the college is actually in a somewhat remote district of Shanghai, called Nanhui (about a 15 minute ride from the Pudong international airport). Personally, I'm happy with teaching here but next semester I want to be closer to the city center, but I think it's a decent job if you don't mind living an hour bus ride away from the closest metro stop (they give a housing subsidy if you want to live off-campus). I have some great colleagues and I can teach the classes however I want.
What spiderman too says about the overtime is right, but it shouldn't really be an issue because last semester I only taught 18 teaching hours per week and this semester only 16, so it's only a few hours per week that I'm making less than the normal contract hours.
Also, don't fret over the organized activities clause. I went to English corner on several occasions, but that was because some of my students asked if I would. The administration only asked me twice the entire semester. Also, I never have to stay in the office, although I often do so to chat with my colleagues and prepare lessons (because I find I have too many distractions in my home to do so!)
Anyways, this was my personal experience with the school. Overall I think it's a good place to teach because the students are good for being a college, you get paid on time, work few hours per week, have a friendly staff and a relaxed atmosphere. If you have any more questions feel free to PM me. |
