I guess it can be in some jurisdictions. Often, it can be satisfied by paying a fine. But if you get caught away from the border or short of cash, you might end up in the klink until you can come up with the scratch. In Singapore, it's a caning for you (males). In the U.S., getting caught in an "overstay" situation merely results in a free ticket home.

This has also been my experience. The immigration guys only really care if you have overstayed or are a wanted criminal and unless there is a huge change in the practices here then I don't see that they will be looking for tax evaders any time soon.

The only tax issue is if you are trying to take more that $10000 US back into the states. But you have to declare it voluntarily...so it is no big deal. Just keep your mouth shut( if you have indeed made that much and are trying to "smuggle" it in".) Otherwise a passport and a passport only will get you out of China and into America.

Not sure if this is true but I have heard...The amount legal to takeout of China differs from the amount legal to take into the US....
