The Ministry of Education has directed that on October 1st, 2003 foreign teachers are prohibited from teaching in kindergartens, altering a previous decree on May, 31st, 2002 that had permitted employment in kindergartens.
Teachers contracts that were signed before October 1st will be accepted and the teachers allowed to finish the term of their contracts. Notifications were sent to all schools throughout all territory controlled by the government of the Republic of China."

You might not be aware, but this has always been the case. Until recently, it was violation of labour and immigration law to have foreign teachers employed in a kindergarten. The change that you are referring to alters a May 1st, 2002 directive permitting the legal employment of foreign teachers under certain circumstances.
My impression of all this is that none of these regulations made much difference to anyone.

The finer points of Republic of China law.
It is against regulations to issue a work permit to teachers working in a kindergarten. However if the teacher has a valid work permit and can obtain a letter from his owner allowing him or her to work in the kindergarten then the teacher is not illegal but the school may be fined. The same is true for people with an open work permit.
The ambiguity created by this flip flop decree issuing is intentional. For several years now the laws and regulations concerning teachers working in Taiwan have become more consistent and transparent making it more difficult for certain officials to enforce their prejudice in certain cases and collect their illicit fees. It was also cutting into the kick backs and payoffs of government officials as the legal way of hiring teachers was too easy and inexpensive. Now, the MOE officials can still collect their bribes even though they no longer have a say in issuing ARC's to foreign teachers. That responsibility has been turned over to the Ministry of Labor or is supposed to be.
In the end nothing was or has changed. |

In most cases it means that schools will have to continue to pay bribes to Ministry of Education officials even though those officials no longer control the foreign teacher's work permits. It may make English immersion Kindergartens more expensive as there are now two government ministries extorting bribes from those schools. |
