Why are we all suprised? racism, violence against a defenceless female
and sexual assualt? Not exactly uncommon crimes in Spain nowadays and you may accuse me of generalisation but I have always found the worst
kind of cowardly behaviour has always been a trait of the Spanish male.
He may get away with his behaviour from the Spanish legal system but now we all know what he looks like, you can bet your life you will be reading about him from a hospital near you anytime soon. He'll get his.. you wait and see.  |

...Ecuador has sent their top lawyer to Spain. apparently, there are going to be 10,000 or more people marching and protesting in the coming days. some say this will explode into a national debate. hard to say what will happen. if it was just the first part of the incident (spitting, profanity, etc) he would walk. but kickboxing someone from behind when they don't see it coming is a lot more serious offense.

The Latin Kings are already on his trail....i read a couple of newsclips that he has received hundreds of threats from the Barcelona based Latin Kings. |

I remember reading somewhere that his grandmother said he was a 'good but troubled boy'. I wouldn't be surprised if his defence came up a case that he suffered psychologically as a child blah blah....how he needs counselling blah blah.....he may well be out in a short time....but what goes around comes around .... |

Under Spanish law that charge covers a multitude of crimes, ranging in severity in the eyes of the Spanish law.
Sexual assault in Spain can mean rape but it can also refer to lesser sexual crimes.
In cases of alleged sexual assault in Spain, there is no trial by jury, but rather by a tribunal of three magistrates.
The maximum sentence under Spanish law is 12 years.
But this increases to up to 15 years if the alleged aggression included a life-threatening weapon or the alleged victim is a minor or physically or mentally disadvantaged. |

so, there's probably two or three different charges all on a minor. |

i was just reading again...i guess the judge threw out the sexual assault charge. and also threw out the kickbox. because there is no medical evidence that she suffered any injuries.
so he has been charged with:
"an attack against the moral integrity of the person with the aggravating circumstance of xenophobia"
"may be sentenced to between six months and two years in prison."
but expect the Ecuadorian lawyer to appeal all this. this case will go on forever. i read they are rearranging the courts in Spain and won't be up to 'full session' until Jan/Feb. |

I've just finished nine years teaching in various parts of Spain and don't remember racism being any more of an issue than it is in most other 'civilised' countries. For the past several years, however, the news reports have emphasised what the government sees as a worrying increase in cases of violence against women (although it may simply be that women feel more able to report it now). Those restraining orders issued by the courts don't seem to make any difference in the majority of cases either. |

takahiwai...yes I noticed that when I worked in Spain- domestic violence there is one of the worst in Europe. Which parts of Spain did you work in? When I worked in bcn, I remember watching a TV show, where a woman complained that her husband used to beat her, the next they heard was that the woman was burnt to death by her husband because she dared speak out on national tv about the issue  |

I very much doubt he will get more than 6 months...sad but true like I said his defence will use the troubled childhood excuse as the main reason for his actions... |

This bloke has cooked his goose big time, I think a long term jail sentence is his only way of staying out of intensive care or worse. (for him that is) |
