Hola!
It is time for me to get back to work! I also need to fix my wayward visa.
In 2003, I broke a contract with a company in Hangzhou. My "Z" visa is current until May 5th, 2004. I have not worked for anyone else for the past 6 monthes.
I live in a small town two hours away, married to a Chinese woman. When I "broke" the contract so to speak, I just moved back "home" with her and basically hung out travelled, tutored and bummed around for 6 monthes. My Z visa was re-issued in Jinhua, the county seat, but my residence permit is stamped by the Hangzhou police (education department) whatever.
Now, I do not want to get a "release" letter from my old employer, because of bad vibes (my fault) but I want to start fresh with a new visa from a new employer here in Hangzhou.
SOOOO, does making a visa run to Hong Kong "clense" me of my past sins here in China? I hear Hong Kong is lovely in May. I can toss my residence book away and start new, right? Or am I in the same old boat with a new employer?

Technically, if you do a HK visa run, the green book is taken by customs and you apply for a new visa before re-entering the mainland. Doing this takes away the need to get a release letter. The release letter is only when you want to get a work visa from a new employer without leaving China and you're still registered with a previous employer.
In other words, leaving the country on a visa run or getting a release letter accomplish the same result: both cancel the previous Z visa and green book.
I'm not exactly sure of your situation. Are you working for a new employer right now? If you are, it's unlikely they would issue you a Z if your previous one isn't cancelled or you don't have a release letter.
If you want to find new work now, why wait until May? You can go to HK, re-enter on a tourist visa, and have the new company apply for your new Z-visa and green book. This will mean a new medical exam and paperwork, however.

I just went to Hong Kong to get a new visa and was told i still needed a realease letter from my last employer. My Z visa had only a couple of days left on it but they still wanted proof i had completed my contract. The travel agent guy said this was a new thing. I am not sure if this was because i wanted a F business visa or if it still applies just for a L tourist. I would try to give someone a call before you head over. |

Senor is labouring under the illusion that he can get a new work visa without formally quitting his former job. The reason why he needs a release letter is precisely because the new employer must prove that there are no skeletons in Senor's wardrobe. The release letter is important as it gets a chop from the PSB, which alone entitles him to be reemployed.
If no release letters were required, some itinerant teachers might ask a school for a loan then disappear; or they might fall foul of the law and disappear - and their employer will be held answerable to the PSB.
His best bet is to get a new passport! |
