Hello all,

I am doing the French Assistantship Program next year and my boyfriend will be coming along with me...I have a question about visa issues though (my apologies if this is posted on the wrong forum).

We will both be in Spain beforehand: he will be there for 4 months and I will be there for 2. Given that we have only 90 days to actually legally stay in Europe, he will clearly be overstaying his allotted time. I've heard though that this is rarely an issue and when you actually leave the Schengen area, they don't care too much. Obviously, one always risks the Big.Red.Stamp. But alas, plans are already made....

So my question is this: when he returns to his home country (Argentina) to get his student visa for France (enrolled in a French Uni so that he can work part time as an ESL teacher) do you think there will be an issue if his passport says that he overstayed his allowed 90 days. Would this prohibit him from re-entering Europe as a student?

Not sure, but I think you can come to the schengen zone, stay for 2 months, then leave for couple days and come back, and your limit counts over, no? At least that is what this site about Schengen visa says. But someone told me that this should change, anyone knows how it really is these days? Tx.

No. The Schengen Visa is specifically designed to stop such border hopping/visa runs. If you stay for 60 days, leave for 2 days and come back then you still only have 30 days left, after which you'd have to leave for 178 days before getting a new visa.

By the way the site you linked doesn't say anything of the sort, it specifically says "The Schengen visa allows the Schengen visa holder to travel freely within the Schengen countries for a maximum stay of up to 90 days in a 6 month period. This means that once a Schengen visa holder has been in one or more Schengen visa countries for 90 days, then he or she must remain outside ALL the Schengen member states for at least 90 days."
