I accepted a job offer a month ago with a company and I sent in my diploma and I emailed a signed scan of my contract to the employer. They said that they would take care of my COE. The job doesn't start until September and they will not get me a work visa until after I arrive in August.
I just got another much better job offer that pays substantially more money with a much stronger contract and better benefits. Is there going to be a problem with me accepting the new job offer and submitting my paperwork for the new company to issue me the COE so that I can work for the new company? The new company wants to do things the way that I have been told is the correct way with the COE and information being mailed back to me so that I can take it to the closest Japanese Embassy so that they can issue me a work visa before I arrive so that I will have it on me upon arrival. Is there going to be any conflict with me accepting this new much better offer considering or any problems with the COE through the new company? |

The first employer will be disappointed, of course, but there is plenty of time for him to get another body. Just apologize, say something came up, and ask to have his application for COE stopped. |

I think you need to talk with the first employer. It is my understanding that if they have already submitted a request for COE/Visa to Japanese Immigration, then the second company cannot hire you. Japan will only issue one COE/Visa per person. So the first company would have to cancel their application for your COE/Visa before the second company can submit an application in your name. |

Well, if it is true (and one would assume it is, at least in the sense of an irate blown-off employer waving a signed contract in Immigration's faces), it'll be even more reason to try to get out of the contract with and impending COE application by the first company! Just don't tell anyone that you are jumping ship though, simply that you aren't coming to Japan ever (to work for the first company) now that your wombat has died or something. And Immigration themselves certainly won't know or probably really care quite what little white lies you'll have been telling that first employer in order to get the first COE (if not the contract) cancelled. |

Well it has only been 15 days since they received my diploma and I never gave them a completed Resume for Visa Application or any taken passport photos to submit if that makes a difference.
I was looking at
http://www.immi-moj.go.jp/english/tetuduki/kanri/shyorui/01.html
to figure out if they were able to process it without passport photos and no Resume for Visa Application. |

Sure, Subkulture, maybe you have found (with this first company) a company that says it is going to get you a COE, when in fact it won't (for whatever reasons) materialize on time if at all...so there could be plenty of time for the second company to "get in there first" and make the first company's claim's somewhat academic. But I myself wouldn't want to risk leaving a clashing contract + COE in the works for any longer than was necessary, if I was intent on starting working in Japan without even a shadow hanging over me let alone any actual hassles potentially appearing at some point. Anyway, I hope things work out in your favour rather than not! (I mean, nobody really wants to work for 210K, do they!). |

Well, if you haven't sent a picture then they probably haven't applied for a COE. The COE has your photo on it. |

My friend had this issue happen a few years ago. She had applied to two eikaiwas at the same time. One offered her a position right away while she was waitlisted for the other. The company she was wait listed for was the one she really wanted to work for, so she submitted the COE stuff to the first company as a back up just incase she never came off the wait list... After a month, the other company gave her and offer, so she resigned from the first company... When the second place submitted an application for a COE immigration told them that there was already a request filed in her name. The other company had not canceled the COE request. |

I emailed the company and got a response from them wishing me luck with my future endeavors but I haven't gotten a confirmation about the COE being canceled.
I did see some pics of COE's online and they all have passport photos attached and the requirements to apply for COE says that it must have a passport photo included so I don't know if it is possible to submit without it.
I am still trying to get a confirmation from the company that they will withdraw their claim for COE. |

No, the second company could not hire her. She ended up having to reapply about six months later after the COE that was eventually issued for the first company expired. |
