Maybe my time in china is finished. My visa now exprired, proves to me the agent had no intention of giving back my passport. I have no issues with the school, they were kind to me, at least they told me they had no licence to employ foriegn teachers, so they were cought between me and the agent. Today they had to let me go, but the agent still wanted to make a deal, take all the money I earned and leave me with nothing and hand back my passport, with a expired visa.
So tomorrow go to the beijing court and tell them everything.
I hope and wish other teachers stay away from agents in china, and have enough money before coming to china. Our industry is sadly being abused. I was a fool to trust her. |

Agent? Do you mean recruiter?
Why would you give the passport to a recruiter. All the recruiter needs is a scan to give to the school who passes it on to whoever issues the LOI.

| I suggest you see your embassy and make sure they know what is going on. They play rough here in China. |

| Embasey already know about the case. I'm in the police station now, waiting for a english speaking police to take me to the court to sort it out. |

| Hewlet I feel shameful, but are you a native speaker.? Not that it matters but your writing is not native like. You might have been trapped. Recruiters are not looking for teachers. They are looking for good looking people. I am sure my diploma has been copied many times by these scoundrels. Go to jail if you have to. The prisoners there will find it interesting that an English teacher has been incarcerated for teaching English. |

We are all expecting a full report on the Chinese justice system. This will be
invaluable for all the Efl instructors here in China as a test case. Then we know
what to expect further down the track. |

Why would you give an agent your passport?

If you get your paperwork done on your end, then you won't be in this mess. You say your visa expired, so it seems like it was a legit job. Then you say they didn't have a license. How can you claim both? I don't see how a school could not have a license and be able to get you get a visa (which you say is now expired).
As for it being expired and you working past that date (if you did), that would be your fault, not "our industry".
I'd say if you had protected yourself in the beginning you would have had 60% less chance of this happening. |

What's with the habit of blaming the victims of crime around here? 
Correct me if I am wrong, but a recruiter said that in order to get the teacher a visa, she will need it to take it to the government office to be processed. Then, she failed to return it but kept it until well over the expiry date.
Call me ignorant, but that is called malicious (with intent to deceive) LYING (saying one thing and doing another) and THEIVERY (taking something that does not belong to you and failing to return it) where I come from...
She was in a position of trust, and she broke that trust.
Questions you need to have answered before you look at recruiters:
Are they a licensed recruiter/agent?
Have they been investigated before?
Do they have references?
How long have they been in operation?
What schools have they recruited for? |

The "teacher" entered the country illegally. Entering on a non-work visa. Then conducted teaching responsibilities (e.g., performed work duties of a job) in violation of visa law. Working illegally is thus the responsibility of the "teacher." That blame starts THERE. |

Because a lot of the problems people suffer from here are problems of their own doing. Have you read the posting history of some of the people on this forum? I can believe some of us are victim to one misfortune at the hands of malicious shysters, maybe two, but not nine or ten. Sooner or later people who come to China and get screwed over repeatedly have to start taking responsibility for getting themselves into bad situations. But in today's "victim" society it's always someone else who's to blame. |

I have always gone with the school. Maybe it gets delivered to the school, but upon delivery (2 weeks or so of waiting) it should be given to the teacher.
Whose responsibility is it to get this? When is it their responsibility? Maybe if this teacher got the passport, they would see the school never processed "it".
I went to one school last year and they never asked me for a medical check. Eventually, I left. The next school immediately asked for it and then found out it was old and I needed a new one.
