I completed my contract with a training school last year, but they treated me very badly, so I found another job at a well-known language mill in the same town (Qingdao). I decided to go home (NZ) for 3 weeks between contracts. I thought it would be no problem to get a new work visa, but my new school tell me they need a reference letter, release letter and cancellation of the FEC before they can issue a new work visa. My old school is pissed off that I went to a different school and are refusing to give the documents.

What can I do?????

I am a good teacher. I did nothing wrong. My employers are very bad, even by Chinese standards. They are the company whose CEO is in jail for raping one of my colleagues � but the company is rotten from the top down � nothing but lies, deceit and exploitation all the way down.

So am I locked out of China now? How can I get a work visa if my previous school won�t release the documents? It seems crazy that a bad employer can keep you from ever working legally in China ever again.

Can I come on a tourist visa, and get it converted? I know people who have done this, but it is risky. Often you must take a trip to HK � that�s if you can even find someone willing to take you on.

There is the possibility of enrolling at university and getting a student visa. Can I do this in country? � ie. come on a tourist visa, if I can�t find a work visa sponsor, enrol in uni, or must I apply for the student visa outside China as per Z visa?

The quickest way to solve the problem is get a new passport and don't tell anyone you worked in China before. This may or may not work. Depends on the computer system of the PSB.

I would come in on a tourist visa and go to your prior school collect the documents and make a HK trip. Do not start work untill the paperwork is straght. The risk is maybe the prior school still refuses but then you can go to SAFEA or the PSB for help.

You could also have your new school go and get the paperwork.

Avoid the student visa, sounds like you really don't want to be a student.

My understanding is that no matter where you worked previously and where you want to work next, you must, in the least have the release letter and in many cases a letter of recommendation.

As far as I know a school is obliged to give teachers a letter of release. How long they may choose to drag their feet over such matters is another thing altogether.

Once course of action is to get someone high up in your new school, the owner if it's a private school, to give the old school a call and get them to mediate on your behalf. It may even come down to chucking a few greenbacks in their direction to get things going. Once your new school can get its mitts on the required documents, it's a green light.

If you are treated so, so, so badly then why would you go out of your way and through the difficulties of deceiving people by getting a new passport, let alone the red-tape of getting a new passport, and stressing over release letters, recommendations, etc. when it would be simpler to get a job in your own home country. What forces you to remain here under such extreme conditions ?
