i would be grateful for feedback regarding interpretation of gratuity entitlement. My recollection of my first entitlement amounted to an extra month for every completed year. (Government H.E)
I am negotiating a second amount with a private company, who appear to be using a convoluted formula and interpreting the amount as 21 days out of 365.
I have read the Labour Law manual and "21 days" is open for discussion as it doesn't state working days..only 21 days wage. What does this mean??

My understanding, too, is that it is 1 month pay for every year you work (base salary, excluding complementary allowances, etc.). Additionally, it should be calculated against your most recent salary figure. Therefore, a promotion/raise or demotion/pay cut can significantly impact the total amount given at the end.
So, if someone knows that they might be getting a pay cut (for budgetary or whatever else reason), it might be prime time to turn in a quick resignation. |
