When I came to Korea I came on a four month contract. My ticket was paid for which was fantastic and I got a lower salary than normal because of the short time period. I signed a year contract so that I could get an E2 visa. Then I signed a shorter four month contract leaving Jan 10. My boss asked me to stay a couple of weeks longer and at the time I agreed. Yet, our relationship has been very up and down and it has been really stressful to work for her. So I decided that I would like to leave on the 10th. I told her this a month before. She said that she would sue me for all the rent that she has paid for my apartment and take the plane ticket back. Consequently I agreed to stay the extra time. It was only two more weeks. Right now, I am just praying that she sticks to what she says.

I am just wondering if she could have done this? Could she sue me even though we have a written contract that I leave on the 10th? It was only a verbal agreement to stay longer. Yet, she does also have a copy of a year contract. I just want to see how truthful she was...

Nope. She would need some form of proof....like a contract. What does the contract say (the paper you scratched your X on)?

Are you planning to come back to Korea? If not, don't worry about it. Just slip out.

She won't sue you because she will get into trouble with immigration herself.

You can only sponsor an E2 visa if your working period is for ONE whole year. The fact that she signed another contract with you for only 4 months should really have cancelled your E2.

I wouldn't worry about it - she is bluffing.

wow, I appreciate all of the replies! The contract, the short one states that I will work from September 5 until December 5 2006. I'm not planning to come back to Korea right away. The soonest would be next September.

Hope she has a foolproof plan to sue you even though you won't be in Korea!!! Nice try, lady. More likely she just won't pay you until she's ready to "let" you go home.

Don't get sucked into the pathetic little power games here. Directors will say ANYTHING to get you to stay as long as it's convenient for them. They don't seem to understand that 1) we're not slaves/endentured servants, and 2) they aren't God. When directors start getting manipulative like this, they don't seem to understand that (for most westerners) it sets of HUGE flashing warning signals and the stress they create just ain't worth it. Hello midnight express!

Do what you need to do, but tell her with a sympathetic tone that you understand, and that she should go ahead and sue. Like she's going to spend a ton of money on a lawyer on a frivolous lawsuit that won't stand up in court. I love calling their bluff on the outrageous lies they tell--it makes them so angry! Ha ha ha.

If you think that she won't pay you if you stick to the short contract that SHE wrote up and agreed to, just quietly wait for payday and then go. Come back to Korea when you're ready. You won't have any problems.

To directly answer you question - I don�t know. However, I would propose she may �be in the right�. If she did in fact pay additional rent to secure your apartment for the time you agreed to extend your contract, she will suffer a loss due to your decision break the verbal agreement you made with her.
