My girlfriend was physically threatened by her boss last week. She is considering a midnight run this week or next, and she has a standing job offer at my school which includes a contract ending on the same day as mine.

However, I remember reading that if you do a midnight run, you can't come back on another E2 visa until the E2 you were on was set to expire. Is this true? What else should we be considering when making this decision? Thanks for your help...

Yes, this is true under the conditions you spoke of. It is also possible that if the boss is angry enough, he can make trouble for your girlfriend in the future by flagging her file in Immigration. (It doesn't happen often, but it does happen. It did to me.)

Your girlfriend MIGHT have an out if she can persuade the boss to give her a letter of release. This would cancel her present visa and allow her to get a new E-2 visa.

Otherwise, the only other option that I know of is for her to get a tourist visa and work illegally, risking a fine and deportation.

Considering she wants out ASAP, I doubt she will get a LOR. I just don't want her to continue working in this environment, as she is getting pretty scared of something happening. She doesn't plan on coming back to Korea after August or October, and also considering how horribly managed this school is, I almost doubt that the director would even have the time or intellect to flag her account. She's from the US so only a 30 day tourist visa...which pretty much sucks.

I don't understand. In your first post, you gave the impression that your friend is here with an E2 visa. Then, in your second post you said she has a toursit visa.
Which one does she have?

If she runs and comes back then she has only a 30 day tourist visa. Canadians get 90 days. It is not easy for an American to come here on a tourist visa and teach illegally.

As bellum said, it sucks because working illegally is difficult because she only has a 30 day tourist visa. Right now she is on an E2 but given the option she might prefer to teach illegally as opposed to staying in the same building as her boss.

She could apply for a 90-day C3 at the Korean consulate in Japan or wherever. But that's only for visiting, not working. Wink

I'm sure I saw some posts on here saying that people have transfered their E2 visa to another employer without getting a letter of release. -Jeff

It is illegal for an employer to verbally abuse, threathen, intimidate, or physically attack an employee.

Call the labor board:

Call 1350 from anywhere without dialing a local number and select a counseling area following voice instructions and you will be connected to a counselor.
After you get through to 1350, press 7 for English and 8 for Chinese. Then you will be connected to a counselor who provides service in each language.
Phone counseling service is available from Monday to Friday, from 9:00 to 18:00.

Thanks for the replies. I talked to my boss and she told me that under the circumstances, she can (i.e., will try to) take her school's name and address to immigration, explain the situation and get the VISA cancelled on her end. I have no idea of the viability of this option.

Not sure I want to release the name of the school, at least not until she leaves. Suffice to say, for this, and myriad other reasons, I would not reccommend anyone work at this school. This is just one of many problems with management.

Do both schools belong to the same hakkwon association? If so, pressure can be put on your gf's school to give her a LOR.

The solution: threaten him. Make it known to the guy that if anything happens to her you will hire someone to do something even worse to him or his wife.
